  1                               A CONCURRENT RESOLUTION
  2    AUTHORIZING THE DEPARTMENT OF HEALTH AND WELFARE, IDAHO STATE SCHOOL AND  HOS-
  3        PITAL, TO ENTER INTO AGREEMENTS WITH THE IDAHO STATE BUILDING AUTHORITY TO
  4        FINANCE CONSTRUCTION OF A LIVING FACILITY.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS, the Department of Health and Welfare, Idaho State School and Hos-
  7    pital,  a licensed intermediate care facility for persons with mental retarda-
  8    tion, is required to provide services, programs and  living  facilities  which
  9    will  enhance  the  client's  independence,  self-sufficiency, and provide for
 10    their health needs and personal development in a safe and secure  environment;
 11    and
 12        WHEREAS,  the  legislative  interim  committee appointed to study this and
 13    related issues determined that the clients now being referred and admitted for
 14    treatment, stabilization and transitional services are  individuals  with  the
 15    most difficult behavioral challenges without options for community care in the
 16    private  sector because they are too dangerous and aggressive or their medical
 17    needs are too complex and demanding; and
 18        WHEREAS, the living units at the Idaho State School and Hospital were  not
 19    designed  or  built to house clients with these complex behavioral challenges,
 20    the facilities are not a safe living environment for either clients or  staff,
 21    and  the  facilities do not allow for alternatives in health care licensure to
 22    achieve efficiencies and economies in treatment and staffing  or  alternatives
 23    in treatment strategies; and
 24        WHEREAS,  the  Department  of Health and Welfare commissioned an architec-
 25    tural study which determined the need to  replace  two  functionally  obsolete
 26    buildings which house the majority of the clients with a new multibed facility
 27    that  meets  current  standards established for this type of facility together
 28    with infrastructure and site improvements to accommodate and enhance  services
 29    to clients now served; and
 30        WHEREAS,  it  is  imperative and necessary that this facility be placed in
 31    service at the earliest possible time to meet the  public  health  and  safety
 32    needs.
 33        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 34    sion of the Fifty-fifth Idaho Legislature, the House  of  Representatives  and
 35    the Senate concurring therein, that the Legislature hereby authorizes and pro-
 36    vides  approval  for  the  Department  of  Health and Welfare to enter into an
 37    agreement or agreements with the Idaho State Building  Authority,  under  such
 38    terms  and  conditions  as  may  be  reasonable and necessary, to provide such
 39    facilities and financing thereof on the site of the  existing  campus  of  the
 40    Idaho  State  School  and  Hospital.  This  authorization  shall be subject to
 41    approval of the Joint Finance-Appropriations Committee by formal adoption of a
 42    motion recorded in its minutes.
 43        BE IT FURTHER RESOLVED  that  this  resolution  constitutes  authorization
 44    required by the provisions of Section 67-6410, Idaho Code.

                STATEMENT OF PURPOSE

     Authorizes the department of Health and Welfare, Idaho State School and
     Hospital, to enter into agreements with the Idaho State building authority to
     finance construction of a living facility. 
     
     
     
     
                     FISCAL NOTE 
     
     Estimated total building costs would be approximately 13.5 million. State general
     fund would be responsible for 6.5 million and the rest would be raised through
