State of Idaho to provide that qualifications for constitutional offices
are exclusive and the same shall not be changed, added to, or diminished

  2    PROPOSING AN AMENDMENT TO ARTICLE XX OF  THE  CONSTITUTION  OF  THE  STATE  OF
  3        IDAHO,  BY THE ADDITION OF A NEW SECTION 5, ARTICLE XX OF THE CONSTITUTION
  4        OF THE STATE OF  IDAHO,  RELATING  TO  QUALIFICATIONS  FOR  CONSTITUTIONAL
  5        OFFICE,  TO  PROVIDE  THAT  QUALIFICATIONS  FOR CONSTITUTIONAL OFFICES ARE
  6        EXCLUSIVE AND THE SAME SHALL NOT BE CHANGED, ADDED TO OR DIMINISHED EXCEPT
  7        BY AMENDMENT TO THE CONSTITUTION OF THE STATE OF  IDAHO  OR  BY  CONSTITU-
  8        TIONAL CONVENTION WHEREBY THE PROPOSED REVISION SHALL BE SUBMITTED TO, AND
  9        ADOPTED  BY, THE PEOPLE; STATING THE QUESTION TO BE SUBMITTED TO THE ELEC-
 10        TORATE; DIRECTING  THE  LEGISLATIVE  COUNCIL  TO  PREPARE  THE  STATEMENTS
 11        REQUIRED  BY  LAW;  AND  DIRECTING  THE  SECRETARY OF STATE TO PUBLISH THE
 12        AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.
                                                                        
 13    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
 14        SECTION 1.  That Article XX of the Constitution of the State of Idaho  be,
 15    and the same is hereby amended by the addition thereto of a NEW SECTION, to be
 16    known and designated as Section 5, Article XX of the Constitution of the State
 17    of Idaho and to  read as follows:
                                                                        
 18             SECTION  5.  SUBMISSION  TO THE PEOPLE REQUIRED FOR REVISIONS OF
 19        QUALIFICATIONS FOR CONSTITUTIONAL OFFICE. Qualifications for  consti-
 20        tutional  offices  are  exclusive  and the same shall not be changed,
 21        added to or diminished except by amendment to this Constitution or by
 22        constitutional convention whereby the proposed revision shall be sub-
 23        mitted to, and adopted by, the people.
                                                                        
 24        SECTION 2.  The question to be submitted to the electors of the  State  of
 25    Idaho at the next general election shall be as follows:
 26        "Shall Article XX, of the Constitution of the State of Idaho be amended by
 27    the  addition  of  a new Section 5, Article XX, to provide that qualifications
 28    for constitutional offices are exclusive and the same shall  not  be  changed,
 29    added to or diminished except by amendment to the Constitution of the State of
 30    Idaho  or  by constitutional convention whereby the proposed revision shall be
 31    submitted to, and adopted by, the people?".
                                                                        
 32        SECTION 3.  The Legislative Council is directed to prepare the  statements
 33    required by Section 67-453, Idaho Code, and file the same.
                                                                        
 34        SECTION 4.  The Secretary of State is hereby directed to publish this pro-
 35    posed constitutional amendment and arguments as required by law.

Statement of Purpose / Fiscal Impact


     
     
                 STATEMENT OF PURPOSE
                       RS 09894 
     
     This legislation proposes an amendment to Article XX of the Constitution of the
     State of Idaho relating to qualifications for constitutional office. 
     
     The legislation provides that qualifications for constitutional office are
     "exclusive" and that the same shall not be changed, added to, or diminished
     except by amendment to the Constitution of the State of Idaho, or by
     constitutional convention whereby the proposed revision shall be submitted to,
     and adopted by, the people of Idaho.
     
     
      
                    FISCAL IMPACT 
     
     The fiscal impact of the proposed legislation will be the cost of the question as
     presented to the people of Idaho by ballot at the next general election. The Office
     of Secretary of State estimates the cost to print and publish the question to be
     approximately $25,000.
