S1291|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1291 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE ISSUANCE OF MARRIAGE LICENSES; REPEALING SECTION 32-414, IDAHO 3 CODE; AND PROVIDING AN EFFECTIVE DATE. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 32-414, Idaho Code, be, and the same is hereby 6 repealed. 7 SECTION 2. This act shall be in full force and effect on and after July 8 1, 2000.
STATEMENT OF PURPOSE RS 09495 This bill is one of a series of bills that the Supreme Court has recommended in its annual report of "defects in the laws" to the Governor as required under article V, section 25 of the Idaho Constitution. This bill repeals I.C. 32-414 which provides that a district judge may waive a three-day waiting period and certain other medical requirements that formerly were to be satisfied prior to the issuance of a marriage license because the sections of the law to which I.C. 32-414 makes reference no longer impose these requirements, and this statute therefore causes confusion. FISCAL NOTE This bill will not have an impact on state or local funds.
