  1                                        AN ACT
  2    RELATING TO REGULATION OF FOOD ESTABLISHMENTS; AMENDING  SECTION  11,  CHAPTER
  3        194,  LAWS OF 1997, TO DELAY THE SUNSET DATE; AMENDING SECTION 12, CHAPTER
  4        194, LAWS OF 1997, TO DELAY THE EFFECTIVE DATE;  AND  DECLARING  AN  EMER-
  5        GENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 11, Chapter 194, Laws of 1997, be, and the same
  8    is hereby amended to read as follows:
                                                                        
  9        SECTION 11. Section 7 of this act shall be null, void and of no force  and
 10    effect on and after July 1, 2000 2002.
                                                                        
 11        SECTION  2.  That  Section 12, Chapter 194, Laws of 1997, be, and the same
 12    is hereby amended to read as follows:
                                                                        
 13        SECTION 12.  Sections 9 and 10 of this act shall  be  in  full  force  and
 14    effect on and after July 1, 2000 2002.
                                                                        
 15        SECTION  3.  An  emergency  existing  therefor,  which emergency is hereby
 16    declared to exist, this act shall be in full force and effect on and after its
 17    passage and approval.

  1                               AMENDMENTS TO SECTION 1
  2        On page 1 of the printed bill,  in  line  5,  following  "1."  delete  the
  3    remainder  of  the  line; delete line 6, and insert: "That Section 11, Chapter
  4    194, Laws of 1997, be, and the same is hereby amended to read as follows:
                                                                        
  5        SECTION 11. Section 7 of this act shall be null, void and of no force  and
  6    effect on and after July 1, 2000 2002.".
                                                                        
  7                                AMENDMENTS TO THE BILL
  8        On page 1, following line 6, insert:
  9        "SECTION  2.  That Section 12, Chapter 194, Laws of 1997, be, and the same
 10    is hereby amended to read as follows:
                                                                        
 11        SECTION 12.  Sections 9 and 10 of this act shall  be  in  full  force  and
 12    effect on and after July 1, 2000 2002."; and in line 7, delete "2" and insert:

 14                                 CORRECTION TO TITLE
 15        On  page 1, in line 2, following "ESTABLISHMENTS;" delete the remainder of
 16    the line; delete line 3, and insert: "AMENDING SECTION 11, CHAPTER  194,  LAWS
 17    OF  1997,  TO DELAY THE SUNSET DATE; AMENDING SECTION 12, CHAPTER 194, LAWS OF
 18    1997, TO DELAY THE EFFECTIVE DATE; AND DECLARING AN EMERGENCY.".

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                            RS09337

The Idaho legislature passed SB 1003 into law in 1997 which 
established a food facility license fee of $55.00. That legislation 
has a sunset provision of July 1,2000. This RS proposes to repeal 
the sunset provision and maintain the authority of the Department 
to collect the $55.00 fee for licensing a food facility. The fee is 
passed on to local health districts to assist in defraying the costs 
of inspecting food facilities.

                         Fiscal Impact

Passage of this RS will maintain the current funding base for operation 
of food inspection program within local health departments. The program 
funding for FY1999 was composed of 40 %state general funds, 40% county 
funds, 19% state contract funds from license fees and 1% miscellaneous 
fees (primarily from teaching food handling classes requested by food 
facilities).  Defeat of this RS would reduce the food safety program 
budget at the local level by approximately $302,000.
