2 RELATING TO PUBLIC SCHOOL SAFETY; AMENDING CHAPTER 9, TITLE 33, IDAHO CODE, BY
3 THE ADDITION OF A NEW SECTION 33-906, IDAHO CODE, TO CREATE THE IDAHO PUB-
4 LIC SCHOOL SAFETY COMMISSION AND TO SPECIFY MEMBERSHIP; AMENDING CHAPTER
5 9, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-907, IDAHO
6 CODE, TO PROVIDE A STATE ASSISTED VARIABLE INTEREST RATE PROGRAM BASED
7 UPON CRITERIA DEVELOPED BY THE COMMISSION; AND AMENDING CHAPTER 9, TITLE
8 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 33-908, IDAHO CODE, TO
9 REQUIRE REPORTS AND TO PROVIDE FOR MONEYS TO BE APPROPRIATED TO THE
10 IDAHO PUBLIC SCHOOL SAFETY COMMISSION FOR PAYMENT OF INTEREST.
11 Be It Enacted by the Legislature of the State of Idaho:
12 SECTION 1. That Chapter 9, Title 33, Idaho Code, be, and the same is
13 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
14 ignated as Section 33-906, Idaho Code, and to read as follows:
15 33-906. IDAHO PUBLIC SCHOOL SAFETY COMMISSION. There is hereby created in
16 the office of the state board of education the Idaho public school safety com-
17 mission. The commission shall be composed of five (5) members appointed by the
18 governor. Not more than three (3) shall be members of the same political
19 party. The members shall be drawn from throughout the state and be as
20 geographically representative of the state as possible. One (1) member should
21 be an elected member of the board of trustees of a school district and one (1)
22 member should be a school district administrator. Members shall serve a term
23 of five (5) years, except that of the members first appointed one (1) shall
24 serve a term of one (1) year, one (1) shall serve a term of two (2) years, one
25 (1) shall serve a term of three (3) years, one (1) shall serve a term of four
26 (4) years, and one (1) shall serve a term of five (5) years. Members shall be
27 reimbursed expenses as provided in section 59-509(b), Idaho Code. The commis-
28 sion shall meet and organize itself upon the call of the governor, and there-
29 after upon the call of the chairman.
30 SECTION 2. That Chapter 9, Title 33, Idaho Code, be, and the same is
31 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
32 ignated as Section 33-907, Idaho Code, and to read as follows:
33 33-907. STATE ASSISTED VARIABLE INTEREST RATE PROGRAM. A school dis-
34 trict that declares a health and safety financial emergency as provided in
35 section 33-1613, Idaho Code, and has been deemed eligible to apply for a loan
36 from the Idaho state building authority as provided in section 33-1126, Idaho
37 Code, to abate unsafe or unhealthy conditions identified, may apply to the
38 commission for consideration of participation in the state assisted variable
39 interest rate program. The commission shall set the interest rate in matters
40 related to the loaning of money to abate safety problems in public school
41 facilities as defined in section 33-1613, Idaho Code.

1 The commission shall establish criteria for the consideration of partici-
2 pation in the state assisted variable interest rate program. The criteria
3 shall address the severity of the safety concern, the number of times patrons
4 of the district have attempted to pass a bond for purposes of addressing the
5 safety concern, the existence of any nonessential activities or services in
6 the school district, the existing bonded indebtedness of the district, unem-
7 ployment, average wage, land ownership in the district and other relevant eco-
8 nomic indicators and other issues as deemed appropriate by the commission.
9 SECTION 3. That Chapter 9, Title 33, Idaho Code, be, and the same is
10 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
11 ignated as Section 33-908, Idaho Code, and to read as follows:
12 33-908. APPROPRIATION TO STATE ASSISTED VARIABLE INTEREST RATE PROGRAM --
13 REPORTS. (1) Each school district which is a participant in the state assisted
14 variable interest rate program from the school safety commission shall account
15 to the commission for the funds in such detail as the commission requires on
16 forms provided by the commission. The difference between the interest rate
17 charged by the state building authority and the interest rate set for payment
18 from the school district by the commission shall be paid by the state directly
19 to the state building authority or other entity holding the bond, equity or
20 other financial obligation. The commission shall certify eligibility and
21 amount to the joint finance-appropriations committee annually. The legislature
22 shall provide by appropriation for the payment of the interest as certified.
23 Such appropriation shall not exceed two million dollars ($2,000,000) during a
24 fiscal year. The amount of the rate of interest that may be paid by the state,
25 depending on the commission's decision shall be between one percent (1%) and
26 five percent (5%).
27 (2) The commission shall report annually to the legislature on this
28 effort.

1 AMENDMENT TO THE BILL
2 On page 1 of the printed bill, delete lines 16 through 41 and delete page
3 2 and insert:

STATEMENT OF PURPOSE

The purpose of this legislation is to create the Idaho Public School Safety
Commission and to specify membership, and to create the "State Assisted
Variable Interest Rate Program".
This bill is a companion bill to S1496aa, regarding the abatement of Health and
Safety deficiencies in Public School Buildings.
Once funds are obtained by a district from the State Building Authority, this
Commission would determine which portion of the interest would be paid by the
State of Idaho.
FISCAL NOTE
Annual fiscal impact has a statutory limitation of $2 million.
