  1                                        AN ACT
  2    RELATING TO ASSAULT AND BATTERY; AMENDING CHAPTER 9, TITLE 18, IDAHO CODE,  BY
  3        THE  ADDITION OF A NEW SECTION 18-916A, IDAHO CODE, TO PROVIDE DAMAGES AND
  4        TO PROVIDE A MISDEMEANOR OFFENSE FOR OFFENSIVE  PHYSICAL  CONTACT  WITH  A
  5        SPORTS OFFICIAL DURING A SPORTING EVENT; AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  9,  Title  18, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 18-916A, Idaho Code, and to read as follows:
                                                                        
 10        18-916A.  SPORTS OFFICIAL -- OFFENSIVE PHYSICAL CONTACT -- DAMAGES -- MIS-
 11    DEMEANOR. (1) In addition to, and not in lieu of any other damages that may be
 12    claimed,  a  plaintiff  who  is  a sports official shall receive damages in an
 13    amount not less than five hundred dollars ($500) nor more  than  one  thousand
 14    dollars ($1,000) in any action in which the plaintiff establishes that:
 15        (a)  The  defendant  intentionally  subjected  the  plaintiff to offensive
 16        physical contact;
 17        (b)  The defendant knew that the plaintiff was a sports  official  at  the
 18        time the offensive physical contact was made;
 19        (c)  The  offensive  physical  contact  was  made  while the plaintiff was
 20        within, or in the immediate vicinity of, a facility at which the plaintiff
 21        served as a sports official for a sports event; and
 22        (d)  The offensive physical contact was made while the plaintiff was serv-
 23        ing as a sports official or within a brief period of time thereafter.
 24        (2)  The court shall award reasonable  attorney's  fees  to  a  prevailing
 25    plaintiff  in  an  action in which damages are awarded under the provisions of
 26    this section.
 27        (3)  It shall be a misdemeanor offense punishable by imprisonment  in  the
 28    county  jail  for a period of time not to exceed one (1) year, or a fine of up
 29    to one thousand dollars ($1,000), or both, for any person to subject a  sports
 30    official to offensive physical contact during a sporting event.
 31        (4)  As used in this section, "sports official" means a person who:
 32        (a)  Serves  as  a  referee, umpire, linesman or judge or performs similar
 33        functions under a different title; and
 34        (b)  Is a member of,  or  registered  by,  a  local,  state,  regional  or
 35        national  organization that engages in providing education and training in
 36        sports officiating.
                                                                        
 37        SECTION 2.  This act shall be in full force and effect on and  after  July
 38    1, 2000.

This act makes offensive physical contact with a sports official 
during a sporting event amisdemeanor offense and provides certain 
damages to the offended official.
