1 AN ACT
2 RELATING TO ACCUMULATION OF UNUSED SICK LEAVE CREDIT BY STATE EMPLOYEES;
3 AMENDING SECTION 67-5339, IDAHO CODE, TO INCREASE THE MAXIMUM UNUSED SICK
4 LEAVE THAT MAY BE CONSIDERED TO DETERMINE THE MONETARY VALUE OF UNUSED
5 SICK LEAVE FOR RETIREMENT PURPOSES AND TO MAKE A TECHNICAL CORRECTION;
6 REPEALING CHAPTER 138, LAWS OF 1999; AND PROVIDING AN EFFECTIVE DATE.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Section 67-5339, Idaho Code, be, and the same is hereby
9 amended to read as follows:
10 67-5339. USE OF UNUSED SICK LEAVE. (1) Upon separation from state
11 employment by retirement in accordance with chapter 13, title 59 or chapter 1,
12 title 33, Idaho Code, an employee's unused sick leave shall be determined
13 based on accumulated sick leave earned subsequent to July 1, 1976, and shall
14 be reported by the employer to the public employee retirement system. A sum
15 equal to one-half (1/2), or the maximum amount allowed by subsection (2)
16 hereof of this section, whichever is the lesser, of the monetary value of such
17 unused sick leave, calculated at the rate of pay for such employee at the time
18 of retirement, shall be transferred from the sick leave account provided by
19 subsection (3) of this section and shall be credited to such employee's
20 retirement account. Such sums shall be used by the Idaho public employee
21 retirement board to pay premiums for such group health, accident, and life
22 insurance programs as may be maintained by the state, to the extent of the
23 funds credited to the employee's account pursuant to this section. Upon an
24 employee's death, any unexpended sums remaining in the account shall revert to
25 the sick leave account.
26 (2) For the purposes of determining the monetary value of unused sick
27 leave, the maximum unused sick leave which may be considered, shall be:
28 (a) During the first ten thousand four hundred (10,400) hours of credited
29 state service, the maximum unused sick leave which may be considered shall
30 be one four hundred ninety-two twenty (192420) hours;
31 (b) During the second ten thousand four hundred (10,400) hours of cred-
32 ited state service, the maximum unused sick leave which may be considered
33 shall be two four hundred forty eighty (240480) hours;
34 (c) During the third ten thousand four hundred (10,400) hours of credited
35 state service, the maximum unused sick leave which may be considered shall
36 be two five hundred eighty-eight forty (288540) hours; and
37 (d) Thereafter, the maximum unused sick leave which may be considered
38 shall be three six hundred thirty-six (336600) hours.
39 (3) Each employer in state government shall contribute to a sick leave
40 account maintained by the public employee retirement system exclusively for
41 the purpose of the provisions of this section. The rate of such contribution
42 each pay period shall consist of a percentage of employees' salaries as deter-
43 mined by the board, and such rate shall remain in effect until next determined

1 by the board. Any excess balance in the sick leave account shall be invested,
2 and the earnings therefrom shall accrue to the sick leave account except the
3 amount required by the board to defray administrative expenses. All moneys
4 payable to the sick leave account are hereby perpetually appropriated to the
5 board, and shall not be included in its departmental budget. The state insur-
6 ance fund and public health districts shall be considered employers in state
7 government for purposes of participation under this section.
8 SECTION 2. That Chapter 138, Laws of 1999, be, and the same is hereby
9 repealed.
10 SECTION 3. This act shall be in full force and effect on and after June
11 30, 2000.
STATEMENT OF PURPOSE

This bill increases the maximum amount of unused sick leave for state employees
that can be credited towards payment of insurance premiums under Idaho Code
67-5339. For qualified state employees retiring with twenty (20) years or more
of continuous service, current law provides that until July 1, 2000 the maximum
hours of sick leave that can be credited to payment of insurance premiums is 336
hours and effective July 1, 2000 and after the limit is 420 hours. This change
would increase the maximum to 600 hours of sick leave for similarly situated state
employees retiring on or after June 30, 2000. Similar increases are provided for
qualified state employees retiring with five (5), ten (IO), fifteen (I 5) and twenty
(20) years of continuous service.
FISCAL IMPACT
This increase can be accommodated with the current contribution rate of 0.65% of
active member pay. It will increase the amortization of the sick leave liability fund
from 4.6 years to about 10 years.
