  1                                        AN ACT
  2    RELATING TO CLASSROOM MANAGEMENT; AMENDING CHAPTER 2, TITLE 33, IDAHO CODE, BY
  3        THE ADDITION OF A NEW SECTION 33-205A, IDAHO CODE, TO  PROVIDE  THAT  EACH
  4        SCHOOL  DISTRICT  BOARD OF TRUSTEES SHALL ESTABLISH A PROCEDURE TO PROVIDE
  5        FOR REMOVAL FROM THE CLASSROOM OF AN UNRULY PUPIL.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 2, Title 33, Idaho Code,  be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 33-205A, Idaho Code, and to read as follows:
                                                                        
 10        33-205A.  REMOVAL FROM CLASSROOM OF UNRULY PUPIL. The board of trustees in
 11    each school district shall establish the procedure to be followed by  certifi-
 12    cated  and noncertificated personnel under its jurisdiction for the purpose of
 13    temporary and immediate removal of any pupil from the classroom for disciplin-
 14    ary reasons or for other conduct disruptive to the instructional effectiveness
 15    of the school. The procedure shall,  at  a  minimum,  provide  the  steps  and
 16    requirements  involved  in removing the student from the classroom; detail the
 17    role of the building administrator; outline  the  steps  and  requirements  by
 18    which a student is returned to the classroom; and provide for a parent-teacher
 19    conference before the student is returned to the classroom, if such conference
 20    is  requested  either by the staff member who caused the student to be removed
 21    or the building administrator. Discipline of students with disabilities  shall
 22    be  in accordance with the requirements of federal law part B of the individu-
 23    als with disabilities education act and section 504 of the rehabilitation act.

  1                               AMENDMENTS TO SECTION 1
  2        On page 1 of the printed bill, delete lines 9 through 13 and insert:
  3        "33-205A. REMOVAL FROM CLASSROOM OF UNRULY PUPIL. The board of trustees in
  4    each school district shall"; in  line  14,  delete  "such";  delete  lines  15
  5    through  22  and insert: "ted personnel under its jurisdiction for the purpose

  7    plinary  reasons  or  for other conduct disruptive to the instructional effec-
  8    tiveness of the school. The procedure shall, at a minimum, provide  the  steps

 15                                 CORRECTIONS TO TITLE
 16        On page 1, in line 3, following "PROVIDE" insert: "THAT EACH  SCHOOL  DIS-
 17    TRICT  BOARD  OF TRUSTEES SHALL ESTABLISH A PROCEDURE TO PROVIDE"; and in line
 18    4, delete "AND TO PROVIDE FOR A PROCEDURE".

                 STATEMENT OF PURPOSE
                       RS 10041 
                           
     The purpose of this legislation is to provide a tool for education employees to
     carry out their duties and provide a safe, barrier- free environment that is
     conducive to learning for students. This legislation requires local school boards to
     establish procedures for certificated and noncertificated personnel involved in the
     supervision of students to temporarily and immediately remove unruly students
     from the classroom. It further requires the procedure to conform to the minimal
     requirements of due process and federal law.
