S1504|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1504, As Amended BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO AERONAUTICS ADVISORY BOARD; AMENDING SECTION 21-132, 3 IDAHO CODE, TO PROVIDE THAT EFFORTS OF THE PUBLIC AND PRIVATE SECTORS BE 4 COMBINED TO MATCH THE AVIATION PROGRAM PLANNED BY CONGRESS FOR THE NEW 5 MILLENNIUM; AMENDING SECTION 21-134, IDAHO CODE, TO INCREASE COMPENSATION 6 FOR MEMBERS OF THE AERONAUTICS ADVISORY BOARD; AMENDING SECTION 21-135, 7 IDAHO CODE, TO INCREASE THE MEMBERSHIP OF AND PROVIDE AN ADDITIONAL QUALI- 8 FICATION FOR CERTAIN MEMBERS OF THE ADVISORY BOARD AND TO MAKE TECHNICAL 9 CORRECTIONS; AND AMENDING SECTION 21-136, IDAHO CODE, TO PROVIDE FOR 10 APPOINTMENT OF A BOARD MEMBER FROM EACH DIRECTOR DISTRICT AND A MEMBER AT- 11 LARGE TO SERVE AS CHAIRMAN OF THE BOARD, TO PROVIDE FOR STAGGERED TERMS OF 12 ADDITIONAL MEMBERS AND TO MAKE A TECHNICAL CORRECTION. 13 Be It Enacted by the Legislature of the State of Idaho: 14 SECTION 1. That Section 21-132, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 21-132. DECLARATION OF PURPOSE. It is hereby found and declared that 17 there exists in the state of Idaho a need to improve and expand air service 18 capabilities to meet the increased demands of air transportation. In view of 19 the rapid growth of this mode of passenger transportation, faster and heavier 20 aircraft, the anticipated use of this system by industry for moving high value 21 goods and merchandise in a minimum of time, to save handling and warehousing, 22 planning to meet future needs is imperative. Such planning must accommodate 23 intrastate and interstate service for passengers and freight into the national 24 system, with implementation as rapidly as possible. The efforts of both the 25 public and private sectors must be combined to match the aviation program 26 planned by congress forimplementation in the early 1970'sthe new millennium. 27 SECTION 2. That Section 21-134, Idaho Code, be, and the same is hereby 28 amended to read as follows: 29 21-134. IDAHO AERONAUTICS ADVISORY BOARD CREATED -- DUTIES -- COMPENSA- 30 TION. There is hereby created and established the Idaho aeronautics advisory 31 board. The board shall consult with and advise the Idaho transportation 32 department on matters concerning aeronautics. Members shall be compensated as 33 provided by section 59-509(gh), Idaho Code. 34 SECTION 3. That Section 21-135, Idaho Code, be, and the same is hereby 35 amended to read as follows: 36 21-135. COMPOSITION OF ADVISORY BOARD -- NUMBER -- APPOINTMENT -- QUALI- 37 FICATIONS. The advisory board shall be composed ofthreeseven (37) members to 38 be appointed by the governor. Not more thantwofour (24) membersthereof39 shall at any time belong to the same political party.Provided, however, two2 1 At least three (23) members of the advisory board shall be rated pilots hold- 2 ing current licenses at the time of appointment. Additionally, the president 3 of the Idaho airport managers association or his designee shall serve as an ex 4 officio nonvoting member. Members shall be successful public spirited citizens 5 of good character, well informed and interested in the construction and main- 6 tenance of aeronautical facilities. Selection and appointment shall be made 7 solely with regard to the best interests of the various functions of the advi- 8 sory board. Each member at the time of his appointment shall be a citizen and 9 resident taxpayer of the state of Idaho, and shall have been a resident of the 10 district from which he is appointed for at least three (3) years., and dDuring 11 his tenure of office no member shall hold or occupy any elective or other 12 appointive office, federal, state, county or municipal, or any office in any 13 political party. 14 SECTION 4. That Section 21-136, Idaho Code, be, and the same is hereby 15 amended to read as follows: 16 21-136. APPOINTMENT OF MEMBERS -- TERM -- VACANCIES. For the purposes of 17 selection of members of the advisory board of aeronautics, one (1) member 18 shall be appointed to represent each director districts no. 1 and 2, one (1)19member to represent director districts no. 3 and 4, and one (1) member to rep-20resent director districts no. 5 and 6,as provided in section 40-303, Idaho 21 Code. A seventh member of the board shall be appointed from the state at-large 22 and shall act as chairman of the board. The chairman of the board shall serve 23 at the pleasure of the governor for an indefinite period. 24 Each of the enumerated districts shall, at all times, be represented by 25 one (1) board member, appointed fromone (1) ofthetwo (2)director districts26 represented. The governor shall appoint the board members, subject to confir- 27 mation by the senate,the board membersfor terms of three (3) years; except 28 that the terms of the additional board members appointed pursuant to this act 29 shall be staggered so that the initial appointment of one (1) member shall be 30 for one (1) year, the initial appointment of one (1) member shall be for two 31 (2) years, and the initial appointment for one (1) member shall be for three 32 (3) years, with the term of each such member to be for three (3) years there- 33 after. The term of each member shall begin immediately upon his appointment 34 and qualification. Each member shall hold office after the expiration of his 35 term until his successor has been appointed. Not less than fifteen (15) days 36 before the expiration of the term of appointment of each member, the governor 37 shall appoint a successor and submit the appointment to the senate for confir- 38 mation. Should any member of the board resign, die, remove from the district 39 from which he was appointed, or otherwise be removed from office, a vacancy 40 shall exist, and during the recess of the legislature, the governor shall 41 within thirty (30) days appoint a successor with like qualifications, to serve 42 for the remainder of the retiring member's unexpired term. If a vacancy occurs 43 within forty-five (45) days after the convening of the legislature and while 44 it is still in session, the governor shall make and submit to the senate for 45 its approval a nomination to fill the vacancy.

STATEMENT OF PURPOSE RS09914-C2 This legislation expands the Aeronautics Advisory Board from three members to six members plus a Chairman at large. This configuration would be similar to the Transportation Board with a representative from each district. The economic impact of Aeronautics in Idaho is estimated to be over $1.3 billion FISCAL NOTE There would be no quantifiable direct fiscal impact to the General Fund, however, with quarterly meetings there would be an additional $8-10,000 total impact to the State Aeronautics Fund.
