TRAFFIC SAFETY COMMISSION - Amends existing law to revise the membership of
the Traffic Safety Commission; to provide terms of service and
compensation; and to provide that the commission shall have an additional
duty to report annually to the Idaho Transportation Board and the germane
transportation committees of the Idaho Legislature regarding the locations
on state highways which have been identified as hazardous, with
recommendations on how to improve safety conditions at the identified

  1                                        AN ACT
  2    RELATING TO THE TRAFFIC SAFETY  COMMISSION;  AMENDING  SECTION  40-508,  IDAHO
  3        CODE,  TO REVISE MEMBERSHIP OF THE COMMISSION AND TO PROVIDE TERMS OF SER-
  4        VICE AND COMPENSATION AND TO MAKE A  TECHNICAL  CORRECTION;  AND  AMENDING
  5        SECTION  40-509,  IDAHO CODE, TO PROVIDE THAT THE COMMISSION SHALL HAVE AN
  6        ADDITIONAL DUTY TO REPORT ANNUALLY TO THE IDAHO TRANSPORTATION  BOARD  AND
  7        THE  GERMANE  TRANSPORTATION COMMITTEES OF THE IDAHO LEGISLATURE REGARDING
  8        LOCATIONS ON STATE HIGHWAYS WHICH HAVE BEEN IDENTIFIED AS HAZARDOUS,  WITH
  9        RECOMMENDATIONS  ON  HOW  TO  IMPROVE  SAFETY CONDITIONS AT THE IDENTIFIED
 10        LOCATIONS.
                                                                        
 11    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 12        SECTION 1.  That Section 40-508, Idaho Code, be, and the  same  is  hereby
 13    amended to read as follows:
                                                                        
 14        40-508.  TRAFFIC  SAFETY  COMMISSION  CREATED  -- MEMBERSHIP. (1) An Idaho
 15    traffic safety commission is established within the department.
 16        (2)  The commission shall be composed of  not  more  than  fifteen  eleven
 17    (151) members appointed by the director, who shall include as follows:
 18        (a)  One  (1) shall be the chairman of the transportation and defense com-
 19        mittee of the house of representatives of the state legislature; and
 20        (b)  One (1) shall be the vice chairman of the transportation and  defense
 21        committee of the house of representatives of the state legislature;
 22        (c)  One  (1) shall be the chairman of the transportation committee of the
 23        senate of the state;, plus the director or his representative who
 24        (d)  One (1) shall be the vice chairman of the transportation committee of
 25        the senate of the state legislature;
 26        (e)  Three (3) members shall be appointed by the governor: one (1)  member
 27        from transportation director district no. 1, one (1) member from transpor-
 28        tation  director  district  no.  3, and one (1) member from transportation
 29        director district no. 5, each to serve an initial term beginning  on  July
 30        1,  2000,  and expiring on June 30, 2002, and thereafter the term shall be
 31        four (4) years;
 32        (f)  Three (3) members shall be appointed by the governor: one (1)  member
 33        from transportation director district no. 2, one (1) member from transpor-
 34        tation  director  district  no.  4, and one (1) member from transportation
 35        director district no. 6, each to serve an initial term beginning  on  July
 36        1,  2000,  and expiring on June 30, 2004, and thereafter the term shall be
 37        four (4) years; and
 38        (g)  One (1) member shall be appointed by the governor from the state  at-
 39        large,  and  such  member  shall serve at the pleasure of the governor and
 40        shall act as chairman. Members shall be representative of state and  local
 41        traffic  oriented  agencies,  the  legislature, the judiciary, and private
 42        organizations and citizen groups of the commission.
 43    Each legislative member's term of service on the commission shall run  concur-

  1    rently  with  his  service as a legislator. Members appointed from the six (6)
  2    transportation director districts shall serve at the pleasure of the governor.
  3    Members shall be compensated as provided in section 59-509(h), Idaho Code.
  4        (3)  The director shall employ necessary  personnel,  shall  have  general
  5    supervision  and control of all activities, functions and employees, and shall
  6    enforce all provisions of the laws of the state  relating  to  highway  safety
  7    programs and administer any other activities as may be required by the federal
  8    highway safety act of 1966 and any amendments to it, and the rules and regula-
  9    tions of the board pertaining to it.
                                                                        
 10        SECTION  2.  That  Section  40-509, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        40-509.  DUTIES OF TRAFFIC SAFETY COMMISSION. The commission shall:
 13        (1)  Periodically review traffic safety  problems  in  Idaho  and  develop
 14    effective plans for additional local-state cooperative activities;
 15        (2)  Recommend  to the director those agency programs and political subdi-
 16    vision programs to receive federal aid for highway safety in  accordance  with
 17    uniform federal standards;
 18        (3)  Advise  and recommend to the director future traffic accident preven-
 19    tion activities; and
 20        (4)  Carry out any other activities as may  be  required  by  the  federal
 21    highway safety act of 1966 and any amendments to it; and
 22        (5)  Report  annually to the Idaho transportation board and to the germane
 23    transportation committees of the Idaho legislature on the ten (10)  most  haz-
 24    ardous intersection and nonintersection locations on the state highway system,
 25    with  recommendations on how to improve safety conditions at each of the iden-
 26    tified locations.

  2        On page 2 of the printed bill, in line 23,  delete "dan-" and in line  24,
  3    delete  "gerous  segments  of"  and  insert:  "hazardous intersection and non-
  4    intersection locations on"; and in line  25,  delete  "segments"  and  insert:
  5    "locations".
                                                                        
  6                                 CORRECTIONS TO TITLE
  7        On page 1, in line 8, delete "SEGMENTS OF" and insert: "LOCATIONS ON"; and
  8    also  in line 8, delete "DANGEROUS" and insert: "HAZARDOUS"; in line 9, delete
  9    "SEG-" and in line 10, delete "MENTS" and insert: "LOCATIONS".

Statement of Purpose / Fiscal Impact


                STATEMENT OF PURPOSE 
                       RS10151 
     
     The purpose of this legislation is to restructure the Traffic Safety Commission
     from fifteen (15) members to a more workable eleven (11) members, to include
     gubernatorial appointees, and to clarify terms of service on the commission. In
     addition to the restructuring the commission, this legislation adds a new duty. In
     addition to the four duties currently assigned, the commission will be tasked with
     annually compiling, publishing and reporting on the ten (10) most hazardous
     segments of state highways in Idaho. The commission will additionally be tasked
     with suggesting recommendations on how to improve safety conditions on each of
     the identified segments. 
     
     
     
     
     
                     FISCAL NOTE 
     
     This legislation will have no impact on the general fund. It is assumed that
     passage of this legislation will reduce current costs to the Traffic Safety
     Commission, as membership on the commission will be reduced from fifteen to
     eleven members.
