S1521|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1521 BY JUDICIARY AND RULES COMMITTEE 1 AN ACT 2 RELATING TO THE DEPARTMENT OF PARKS AND RECREATION; AMENDING CHAPTER 42, TITLE 3 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-4239, IDAHO CODE, TO 4 GIVE THE DIRECTOR OF THE DEPARTMENT OF PARKS AND RECREATION AUTHORITY TO 5 ISSUE UNIFORM CITATIONS FOR CERTAIN VIOLATIONS ON DEPARTMENT PROPERTIES, 6 TO PROVIDE FOR DELEGATION OF AUTHORITY AND TO PROVIDE FOR DEVELOPMENT OF A 7 TRAINING COURSE; AND DECLARING AN EMERGENCY. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 42, Title 67, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 67-4239, Idaho Code, and to read as follows: 12 67-4239. ENFORCEMENT AUTHORITY. (1) The director of the department of 13 parks and recreation may issue Idaho uniform citations, as provided for by the 14 rules of the court for the magistrates division of the district court and the 15 district court, to violators of title 67, chapters 42 (state parks), 70 (safe 16 boating act), 71 (recreational activities) and 75 (marine sewage disposal 17 act), Idaho Code, and rules adopted under those chapters, within properties 18 owned and managed by the department. The director may delegate this authority 19 to qualified employees of the department. 20 (2) The department of parks and recreation shall develop, with the guid- 21 ance and approval of the peace officers standards and training academy, an 22 appropriate training course for employees applicable to issuing citations as 23 authorized and delegated in this section. The director shall ensure, before 24 delegating authority under this section, that employees successfully complete 25 the training course. 26 SECTION 2. An emergency existing therefor, which emergency is hereby 27 declared to exist, this act shall be in full force and effect on and after its 28 passage and approval.
STATEMENT OF PURPOSE RS10112 This proposal will give the director of the Department of Parks and Recreation the authority to issue citations for violations to specific recreation codes. These codes are limited to Chapters 42 (State Parks) , 70 (Idaho Safe Boating Act), 71 (Recreation Activities) and 75 (Marine Sewage Disposal Act) Title 67, Idaho Code. The authority in this proposal is limited to actions within properties owned and managed by the department. This proposal allows the director to delegate this authority to certain employees of the department. This proposal requires the department to develop training standards and ensure that employees are adequately trained before being allowed to use this authority. FISCAL IMPACT This proposal has no new fiscal impact. The Department of Parks and Recreation currently trains its field staff in law enforcement skills including annual certification for certain defensive tools. The cost of the department's current training will be refocused to meet the requirements of this proposed legislation.
