S1543|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1543 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO TECHNOLOGICAL INSTRUCTION; AMENDING SECTION 33-1003C, IDAHO CODE, 3 TO EXTEND THE SPECIAL APPLICATION OF THE SCHOOL FOUNDATION PROGRAM FOR 4 TECHNOLOGICAL INSTRUCTION THROUGH SCHOOL YEAR 2000-2001, AND TO MAKE A 5 TECHNICAL CORRECTION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 33-1003C, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 33-1003C. SPECIAL APPLICATION -- TECHNOLOGICAL INSTRUCTION. For the 10 school years 1998-99,and1999-2000 and 2000-2001, in order to acquire and 11 maintain technology for individualized computer and/or distance learning pro- 12 grams, a school district may usestudent'sstudents' documented contact hours 13 on individualized computer education or distance learning programs in deter- 14 mining the district's average daily attendance, whether the student is actu- 15 ally in the computer lab or distance learning center, or has logged on to the 16 computer from another location. A district's technology instruction programs 17 shall be subject to the following provisions: 18 (1) The certification requirements for an alternative school using the 19 individualized computer education or distance learning program may be met by 20 having a properly certificated teacher available on a consultant tutorial 21 basis. The consultant tutors will be available by telephone, fax, e-mail, or 22 in person at the school site on a daily basis. 23 (2) Districts claiming average daily attendance pursuant to this section 24 shall submit annual evaluations of the program to the state board of educa- 25 tion. 26 (3) Districts may offer individualized computer education or distance 27 learning programs on a calendar which may differ from the rest of the 28 district's instruction, but in no case may a district claim more average daily 29 attendance for a student than the full-time equivalency of a regular term of 30 attendance for a single student. 31 (4) Nonalternative high school students may receive individualized com- 32 puter education or distance learning instruction and credit through an alter- 33 native school site.
STATEMENT OF PURPOSE RS 10199 This purpose of this legislation is to extend the sunset clause for one year on the statute which provides for schools to claim average daily attendance state reimbursement for contact hours on a computer with tutorial assistance. Computerized tutorial learning programs enable many students to progress relatively independently at their own rate and level and with limited assistance from a qualified tutor. Many minority limited English proficiency students learn at their own rate and ability level in a computerized tutorial learning program. Students can earn credits even though their work schedule and family responsibilities make it very difficult to attend school on a traditional schedule. Homebound and incarcerated students who cannot attend regular classes can use technology to receive instruction. Several Eastern Idaho school districts, Meridian, and the Grangeville district would like to work together with the Idaho School Boards Association, the IEA, the State Department of Education, and the Idaho Association of School Administrators to develop a comprehensive proposal for 2001 legislation. FISCAL IMPACT There is no significant fiscal impact projected for the FY 2001 year authorized by this proposed legislation.
