  1                                 A SENATE RESOLUTION
  2    STATING LEGISLATIVE FINDINGS AND AMENDING RULE 6 OF THE RULES  OF  THE  SENATE
  3        AND TO PROVIDE AN EFFECTIVE DATE.
                                                                        
  4    Be It Resolved by the Senate of the State of Idaho:
                                                                        
  5        WHEREAS, the Senate finds it desirable to amend Rule 6 of the Rules of the
  6    Senate.
  7        NOW,  THEREFORE, BE IT RESOLVED by the members of the Senate, assembled in
  8    the Second Regular Session of the Fifty-fifth Idaho Legislature, that  Rule  6
  9    of the Rules of the Senate be amended to read as follows:
                                                                        
 10                                        RULE 6
                                                                        
 11             Calling  any  Senator to the Chair. -- (A) The President may, in
 12        the temporary absence or disability temporary incapacity of the Pres-
 13        ident Pro Tempore, or with his consent, designate, either verbally or
 14        in writing, any Senator to perform the duties of the Chair who shall,
 15        during such time, be invested with all powers and privileges  of  the
 16        President  except  that  of  signing bills and joint resolutions, but
 17        such appointment shall not extend beyond an adjournment.
 18             (B)  Succession to Office of President Pro Tempore of  the  Sen-
 19        ate.  Upon  the  death,  removal, permanent incapacity or resignation
 20        from office of the President Pro Tempore of the Senate, during a leg-
 21        islative session, the Senate shall proceed to elect a  new  President
 22        Pro  Tempore.  In  the  event  of  the President Pro Tempore's death,
 23        removal, resignation or permanent incapacity between legislative ses-
 24        sions, the Senate Majority Leader (and in the  event  of  his  death,
 25        removal, resignation or permanent incapacity to act as interim Presi-
 26        dent  Pro Tempore, the Senate Assistant Majority Leader) shall act as
 27        interim President Pro Tempore with all of the duties, powers and pre-
 28        rogatives of the office, to serve until the next session of the  Leg-
 29        islature, at which time a new President Pro Tempore shall be elected.
 30        BE  IT FURTHER RESOLVED that this Resolution and the Rule contained herein
 31    shall be effective upon adoption of the Resolution by the Senate.

                STATEMENT OF PURPOSE 
                      RS 10311 
     
     This bill would clarify that the President Pro Tempore and the Speaker of the
     House of Representatives are the officials who are authorized to make
     expenditures out of the legislative account and to sign vouchers or claims for
     payment, and that those signatures are sufficient authority for the State Controller
     to pay the same.
