SPEAKER Reqquested by: Department of Health and Welfare 1 AN ACT 2 RELATING TO MEDICAL ASSISTANCE; AMENDING SECTION 56-227E, IDAHO CODE, TO CLAR- 3 IFY CONDITIONS WHICH CONSTITUTE A VIOLATION OF THE LIMITATION ON CLAIMS 4 FOR TRANSPORTATION OF MEDICAID CLIENTS; AND AMENDING SECTION 2, CHAPTER 5 360, LAWS OF 2000, TO EXTEND THE SUNSET CLAUSE. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 56-227E, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 56-227E. TRANSPORTATION OF MEDICAID CLIENTS. When five (5) or more medic- 10 aid clients are being transported by a noncommercial transportation provider 11 in a motor vehicle, reimbursement to the driver or the owner of the motor 12 vehicle shall be calculated as though the vehicle contained five (5) clients. 13 If this section creates an undue hardship, the director may, in writing and 14 signed by the director, grant exceptions on a case-by-case basis. Any person 15receivingwho submits a claim for reimbursement beyond the amounts allowed in 16 this section shall be subject to the provisions of sections 56-209h and 17 56-227A through 56-227C, Idaho Code, and the director shall promptly cause 18 such actionsas appropriate to be instituted. 19 SECTION 2. That Section 2, Chapter 360, Laws of 2000, be, and the same 20 is hereby amended to read as follows: 21 SECTION 2. An emergency existing therefor, which emergency is hereby 22 declared to exist, this act shall be in full force and effect on and after its 23 passage and approval; provided that the provisions of this act shall be null, 24 void and of no force and effect on and after June 30, 20012.
STATEMENT OF PURPOSE RS 10557 SB 1530 was enacted by the 2000 legislature to limit to five (5) the number of persons in one vehicle for whom noncommercial transportation provides could charge the Medicaid program. The proposed legislation extends the effective period of the law to June 30, 2002, and clarifies what constitutes a violation of the law and the sanctions that apply. FISCAL IMPACT The proposed legislation, in conjunction with other cost saving measures related to transportation, is estimated to save approximately $724,000.
