SPEAKER Requested by: Bureau of Occupational Licenses 1 AN ACT 2 RELATING TO THE BOARD OF PSYCHOLOGIST EXAMINERS; AMENDING SECTION 54-2305, 3 IDAHO CODE, TO PROVIDE OTHER DISCIPLINE OPTIONS TO THE BOARD; AMENDING 4 SECTION 54-2312, IDAHO CODE, TO PROVIDE FOR QUALIFICATIONS FOR THE 5 ENDORSEMENT OF LICENSES; AND AMENDING CHAPTER 23, TITLE 54, IDAHO CODE, BY 6 THE ADDITION OF A NEW SECTION 54-2312A, IDAHO CODE, TO PROVIDE FOR SENIOR 7 PSYCHOLOGIST LICENSURE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 54-2305, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 54-2305. BOARD OF PSYCHOLOGIST EXAMINERS -- POWERS. The board of psychol- 12 ogist examiners shall have the following powers: 13 (a) To pass upon the qualifications and fitness of applicants for 14 licenses and reciprocal licenses; and, at its option to adopt and revise rules 15 requiring applicants to pass examinations relating to their qualifications as 16 a prerequisite to the issuance of licenses. 17 (b) To adopt, and, from time to time, revise such rules in accordance 18 with the provisions of chapter 52, title 67, Idaho Code, and not inconsistent 19 with the law as may be necessary to carry into effect the provisions of this 20 act. Such rules shall include, but need not be limited to, (1) a code of eth- 21 ics for psychologists in the state consistent with the current, and as future 22 amended, ethical standards for psychologists of the American psychological 23 association; (2) the educational and professional qualifications of applicants 24 for licensing under this act. 25 (c) To examine for, deny, approve, issue, revoke, suspend, or impose 26 other discipline, and renew the licenses of psychologists and psychologist 27 applicants pursuant to this act, and to conduct hearings in connection there- 28 with. 29 (d) To conduct hearings upon complaints concerning violations of the pro- 30 visions of and the rules adopted pursuant to this act and cause the prosecu- 31 tion and enjoinder of all such violations. 32 (e) The board, or its duly appointed hearing officer, shall have the 33 power in any disciplinary proceeding under this chapter, to administer oaths, 34 take depositions of witnesses within or without the state in the manner pro- 35 vided by law in civil cases, and may apply to any district court of this state 36 for a subpoena to require the attendance of such witnesses and the production 37 of such books, records, and papers as it deems necessary. The fees and mileage 38 of the witnesses shall be the same as that allowed in district courts in crim- 39 inal cases, which fees and mileage shall be paid in the same manner as other 40 expenses of the board are paid. In any case of disobedience to, or neglect of, 41 any subpoena or subpoena duces tecum served upon any person, or the refusal of 42 any witness to testify to any matter regarding which he may be lawfully inter- 43 rogated. It shall be the duty of any district court in this state, on applica- 2 1 tion by the board, to compel compliance with the subpoena by proceedings for 2 contempt, as in the case of disobedience of the requirements of the subpoena 3 issued from such court for refusal to testify therein. The licensed person 4 accused in such proceedings shall have the same right of subpoena. 5 (f) Proceedings before the board and judicial review of the action of the 6 board shall be governed by the provisions of chapter 52, title 67, Idaho Code. 7 (g) To authorize, by written agreement, the bureau of occupational 8 licenses as agent to act in its interest. 9 (h) To adopt a rule requiring continuing education as a condition of con- 10 tinued licensure. 11 SECTION 2. That Section 54-2312, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 54-2312. QUALIFICATIONS FOR LICENSE --RECIPROCITYENDORSEMENT. The board 14 may recommend the granting of a licensewithout examinationto any person who,15at the time of application,is licensed or certified by a regulatory board of 16 psychologistsexaminers of another state, provided the requirements for such17certification or licensure were substantially the equivalent of the require-18ments of this act, and upon payment of a one hundred dollar ($100) feein the 19 United States or Canada where such certification or licensure was based on a 20 doctoral degree and who: 21 (1) Submits a complete application, including the application fee and a 22 license fee not to exceed two hundred dollars ($200) as established by board 23 rule; 24 (2) Is of good moral character; 25 (3) Has not had a certification or license revoked, suspended or other- 26 wise sanctioned; and 27 (4) Has certified under oath that they have reviewed and will abide by 28 the laws and rules governing the practice of psychology in Idaho and the code 29 of ethics of the American psychological association and either: 30 (a) Holds a current certificate of professional qualification in psychol- 31 ogy; or 32 (b) Meets the requirements of section 54-2307(b), Idaho Code, and board 33 rules relating to endorsement and educational and credentialing require- 34 ments for licensure. 35 SECTION 3. That Chapter 23, Title 54, Idaho Code, be, and the same is 36 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 37 ignated as Section 54-2312A, Idaho Code, and to read as follows: 38 54-2312A. SENIOR PSYCHOLOGIST. The board may grant a license to any per- 39 son who submits a completed application, including the application fee and a 40 license fee not to exceed two hundred dollars ($200) as established by board 41 rule, and who: 42 (1) Is of good moral character; 43 (2) Has maintained a valid psychology license based on a doctoral degree 44 in the United States or Canada for a period of not less than twenty (20) 45 years; 46 (3) Has a documented record of psychology practice for five (5) of the 47 last seven (7) years immediately prior to the date of application; 48 (4) Has met the continuing education requirement of the board for not 49 less than five (5) calendar years immediately prior to the date of applica- 50 tion; 51 (5) Has not been the subject of any disciplinary action within the last 3 1 seven (7) years prior to application or has never voluntarily surrendered a 2 license to practice psychology in any jurisdiction; and 3 (6) Has certified under oath that he has reviewed and will abide by the 4 laws and rules governing the practice of psychology in Idaho and the code of 5 ethics of the American psychological association.

REPRINT REPRINT REPRINT REPRINT REPRINT REPRINT STATEMENT OF PURPOSE RS 10493 This legislation changes the term "reciprocity" to "endorsement", "reciprocity" has been misused in the statute, as it usually requires written agreements between states that agree to "reciprocate licenses." The board has not been successful in locating states wishing to enter into reciprocity agreements. The board grants licenses to those licensed in other jurisdictions through endorsement, which is a comparison of the relevant requirements for licensure to insure compatibility with Idaho's requirements. The addition of "senior Psychologist" will allow the board to grant an endorsement license to persons based on extensive experience in another jurisdiction. FISCAL IMPACT There is no fiscal impact to the general fund or dedicated funds.
