  1                                        AN ACT
  2    RELATING TO THE BOARD OF PODIATRY; AMENDING SECTION  54-607,  IDAHO  CODE,  TO
  3        INCREASE  THE  MAXIMUM  AMOUNT THE BOARD MAY CHARGE FOR PODIATRY LICENSES;
  4        AMENDING SECTION 54-608, IDAHO CODE, TO PROVIDE THAT THE BOARD MAY  IMPOSE
  5        DISCIPLINE  OTHER  THAN SUSPENSION, DENIAL, REFUSAL TO RENEW OR REVOCATION
  6        OF LICENSE; AND AMENDING SECTION  54-613,  IDAHO  CODE,  TO  PROVIDE  THAT
  7        APPLICANTS LICENSED IN ANOTHER STATE MAY QUALIFY FOR A LICENSE BY ENDORSE-
  8        MENT  UNDER  CERTAIN  CONDITIONS AND TO DELETE REFERENCES TO WRITTEN, ORAL
  9        AND PRACTICAL EXAMINATIONS.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION 1.  That Section 54-607, Idaho Code, be, and the  same  is  hereby
 12    amended to read as follows:
                                                                        
 13        54-607.  LICENSES  --  ISSUANCE  --  RENEWALS -- DISPLAY. If the applicant
 14    shall pass a satisfactory examination, and shall show that he is a  person  of
 15    good  moral  character  and  he  possesses the qualifications required by this
 16    chapter to entitle him to a license as a podiatrist, he shall be entitled to a
 17    license authorizing him to practice podiatry within the state of  Idaho.  Said
 18    successful  applicant shall be issued his license by the board upon payment of
 19    the original license fee which shall be the same fee as required for renewal.
 20        All licenses to practice podiatry shall expire on the 30th day of June  of
 21    each  year;  all  licensed  podiatrists  are entitled to and shall renew their
 22    licenses on or before the 1st day of July of each year; and shall make  appli-
 23    cation  therefor,  accompanied by an annual renewal license fee established by
 24    board rule not to exceed one four hundred seventy-five dollars  ($175400)  for
 25    podiatrists.  Payment  of  fees  herein provided, and satisfactory evidence of
 26    having complied with continued education requirements as established by  board
 27    rules are a condition precedent for issuance of a license.
 28        Every  person  to  whom  a license is granted shall have such license dis-
 29    played continuously in a conspicuous part of his office wherein  his  practice
 30    of podiatry is conducted.
 31        The  board  shall  keep  on file a register of all applicants for license,
 32    rejected applicants, and licensees.
 33        The fee for reinstatement of a license shall be  as  provided  in  section
 34    67-2614,  Idaho  Code.  All  fees  shall be paid to the bureau of occupational
 35    licenses.
                                                                        
 36        SECTION 2.  That Section 54-608, Idaho Code, be, and the  same  is  hereby
 37    amended to read as follows:
                                                                        
 38        54-608.  GROUNDS FOR SUSPENSION, DENIAL, REFUSAL TO RENEW OR REVOCATION OF
 39    LICENSE. No license may be issued, and a license previously issued may be sus-
 40    pended  or  revoked,  or  other discipline may be imposed by the board, if the
 41    person applying, or the person licensed is:

  1        1.  Found guilty by a court of competent jurisdiction of a felony  or  any
  2    offense involving moral turpitude;
  3        2.  Found  by the board to be a repeated and excessive abuser of any drug,
  4    including alcohol, or any controlled substance;
  5        3.  Found by the board to be in violation of any provision of this act  or
  6    the rules promulgated pursuant thereto;
  7        4.  Found by the board to have used fraud or deception in the procuring of
  8    any license;
  9        5.  Found  by  the  board  to  have  had any action, including denial of a
 10    license or the voluntary surrender of or voluntary limitation  on  a  license,
 11    taken  against  the licensee by any peer review body, any health care institu-
 12    tion, any professional medical  society  or  association  or  any  court,  law
 13    enforcement or governmental agency; or
 14        6.  Found by the board to have been unethical, unprofessional or dishonor-
 15    able in the practice of healing the sick.
                                                                        
 16        SECTION  3.  That  Section  54-613, Idaho Code, be, and the same is hereby
 17    amended to read as follows:
                                                                        
 18        54-613.  LICENSE WITHOUT WRITTEN EXAMINATION BY ENDORSEMENT. The board may
 19    issue a license to an applicant by endorsement where the applicant has  passed
 20    an  examination  for and is currently licensed to practice podiatry in another
 21    state, or who has successfully passed the written examination of a  recognized
 22    national  certifying agency in podiatry; provided that the written examination
 23    upon which the licensure application is based  was,  in  the  opinion  of  the
 24    board,  substantially equivalent to its own written examination. The applicant
 25    must satisfy in all other respects the requirements for licensure in this act,
 26    including  successfully  passing  an  oral  and/or  practical  examination  if
 27    required by board rule and any rules adopted by the  board.  All  applications
 28    for  licensure by endorsement must be accompanied by an application fee and by
 29    an examination fee as established by board rule not  to  exceed  four  hundred
 30    dollars ($400).

Statement of Purpose / Fiscal Impact


                   STATEMENT OF PURPOSE
                        RS 10487

This legislative change will allow the board to increase 
fees by rule in order to correct the board's deficit 
financial position.

This legislation also allows the board the discretion to 
apply discipline other than the suspension or revocation 
of a license. This action is taken at the Deputy AG's 
suggestion which will allow the board to enter into consent 
agreements with licensees to assess fines and recover costs 
rather than being forced to go through the hearing process 
(which is more costly to both the board and the licensee; 
typically $5 - $50 thousand).

This also  allows the board to recognize examinations other 
than it's own, when considering the applications for licensure 
of persons already licensed in another state. Because the 
board does not offer oral/practical examination, the change 
also deletes reference to such exams.

                        FISCAL IMPACT

There is no fiscal impact to the general fund.  An increase 
in fees will be necessary by rule to meet operating expenses.  
The overall estimated increase in annual revenue is $8,400 in 
dedicated funds.
