SPEAKER Requested by: Idaho State Police 1 AN ACT 2 RELATING TO PEACE OFFICERS STANDARDS AND TRAINING; AMENDING SECTION 31-3201B, 3 IDAHO CODE, TO PROVIDE FOR AN INCREASE IN PENALTY ASSESSMENT FUNDS AND TO 4 MAKE A TECHNICAL CORRECTION. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 31-3201B, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 31-3201B. PEACE OFFICERS STANDARDS AND TRAINING -- FEE. The court shall 9 charge a fee ofsixnine dollars ($69.00) for peace officers standards and 10 training purposes to be paid by each person found guilty of any felony or mis- 11 demeanor, or found to have committed an infraction or any minor traffic, con- 12 servation or ordinance violation, except for cars unlawfully left or parked or 13 when the court orders such fee waived because the person is indigent and 14 unable to pay such fee; provided, however, that the judge or magistrate may in 15 his discretion consolidate separate nonmoving traffic offenses into one (1) 16 offense for purposes of assessing such fee. Such fees shall be in addition to 17 all other fines and fees levied. Such fees shall be paid to the county trea- 18 surer who shall, within five (5) days after the end of the month, pay such 19 feesinto the state treasurer for deposit in the peace officers standards and 20 training account.
STATEMENT OF PURPOSE RS 10547 POST Academy is funded solely from dedicated funds through a penalty assessment from Idaho Code 31-3201B. The POST budget is presently more than the revenue generated through this assessment. This proposal amends Idaho Code 31-3201B to raise the assessment from six dollars ($6.00) to nine dollars ($9.00), effective July 1, 2001. Without an increase, POST will have to drastically cut back its operations and charge a large tuition to city, county and state agencies for sending their officers to the basic training academy. This fee increase has the full support of the POST Council, the Idaho Association of Chiefs' of Police and the Idaho Sheriffs' Association. FISCAL NOTE There will be no fiscal impact to the state of Idaho or other levels of government. The increase in needed revenues for the POST Academy would be generated from the actual law violators, not the citizens of Idaho in general.
