SPEAKER Requested by: Division of Financial Management 1 AN ACT 2 RELATING TO THE MEAL ALLOWANCE FOR STATE OFFICERS, AGENTS AND EMPLOYEES SET BY 3 THE STATE BOARD OF EXAMINERS; AMENDING SECTION 67-2008, IDAHO CODE, TO 4 PROVIDE FOR AN IN-STATE AND OUTSIDE THE STATE MEAL ALLOWANCE THAT IS NO 5 HIGHER THAN ALLOWED UNDER THE INTERNAL REVENUE CODE AND TO MAKE TECHNICAL 6 CORRECTIONS. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 67-2008, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 67-2008. DETERMINATION OF RATE OF ALLOWANCE. (1) At its first meeting 11 after the effective date of this act, and thereafter as it shall deem appro- 12 priate, the board of examiners shall by regulation fix a rate of allowance for 13 per diem subsistence for officers, agents and all other employees of the state 14 who are absent from their post of duty on official business, which shall be 15 effective for the year in which such allowance is fixed, and shall fix a rate 16 of allowance for mileage for official travel executed by privately owned means 17 of conveyance, which rate of allowance shall be effective for the year in 18 which it is fixed; provided, however, that the board shall fix no rate of per 19 diem allowance which is higher than: 20 (a) Actual lodgings (maximum to be set by board of examiners) andtwenty21dollars ($20.00) per daymeal allowance which is no higher than allowed 22 under the Internal Revenue Code for travel within the state; and 23 (b) Actual lodgings (maximum to be set by board of examiners) andthirty24dollars ($30.00)meal allowance which is no higher than allowed under the 25 Internal Revenue Code without the state; and 26 (c) A rate of mileage allowance which is no higher than the standard 27 mileage rate for the business use of an automobile allowed under the 28iInternalrRevenuecCode for income tax purposes; and 29 (d) The mileage allowance for private aircraft travel shall be set by the 30 board and shall be no higher than that allowed for automobile travel, cal- 31 culated as if the travel had been by highway route. 32 (2) In fixing rates of allowance under this act, the board shall consider 33 the prevailing cost of executing such travel, generally prevailing economic 34 conditions, and the rates of allowance made applicable to similar travel by 35 the federal government and private employers within the state. 36 (3) For a period where employees are to be absent from their post on 37 official business for less than twenty-four (24) hours the board's regulations 38 shall provide for partial days' subsistence rates.
STATEMENT OF PURPOSE RS 10549 The purpose of this legislation is to remove the specific dollar amount limitation on meal reimbursements from Idaho Code as approved by the Board of Examiners on October 10, 2000. This change will require the Board of Examiners to set the reimbursement rate for meals in the same manner as is currently done for mileage of private vehicles in the State Travel Policy. This change will allow more timely changes to the State Travel Policy. FISCAL IMPACT The proposed change to I.C. 67-2008 will not in itself have a fiscal impact. The fiscal impact will occur when the Board of Examiners makes a change to the current State Travel Policy. Preliminary estimates of raising the in-state rate to $30/day could cost an additional $1 million to $1.6 million per year statewide all funds.
