  1                                        AN ACT
  2    RELATING TO THE DEPARTMENT OF  AGRICULTURE;  AMENDING  SECTION  22-107,  IDAHO
  3        CODE, TO PROVIDE THAT THE DEPARTMENT OF AGRICULTURE MAY DEVELOP AND IMPLE-
  4        MENT  SERVICES  RELATING TO HAZARD CONTROLS, GOOD MANUFACTURING PRACTICES,
  5        FOOD SAFETY MANUALS FOR PACKHOUSE  OPERATIONS,  SANITATION  STANDARDS  AND
  6        OPERATING  PROCEDURES  FOR  PRODUCERS  AND PACKERS AND TO MAKE A TECHNICAL
  7        CORRECTION.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 22-107, Idaho Code, be, and the  same  is  hereby
 10    amended to read as follows:
                                                                        
 11        22-107.  VOLUNTARY SERVICES FOR PUBLIC -- FEES -- APPROPRIATION OF MONEYS.
 12    The  department of agriculture may after notice and hearing provide by regula-
 13    tion rule for voluntary services to be performed by it at the request  of  the
 14    public,  such  as developing and implementing services relating to hazard con-
 15    trols, good manufacturing practices, food safety manuals for packhouse  opera-
 16    tions,  sanitation  standards and operating procedures for producers and pack-
 17    ers, laboratory analyses and testing, inspecting, grading,  sampling  and  all
 18    similar  things.  It  may also provide for reasonable fees for performing such
 19    voluntary services; the moneys derived from this activity  shall  be  received
 20    and  handled  as provided for by sections 67-3609 and 67-3611, Idaho Code. The
 21    department of agriculture may also receive and use as directed any  donations,
 22    grants  or  federal  funds available for such purposes to be  accounted for as
 23    prescribed by the state controller and any such moneys the department receives
 24    are hereby appropriated for the purpose for which they are received only,  and
 25    may be spent for such purposes by the department of agriculture.

                      STATEMENT OF PURPOSE
                                
                            RS 10479

Amend section 22-107, Idaho Code, to provide the Department the
authority to develop and implement services relating to hazard
controls, good manufacturing practices, food safety manuals for
packhouse operations, and sanitation standards and operating
procedures for producers and packers.

Idaho producers and packers are being required by the buyers of
their commodities to have third party audits or inspections in
the areas listed above before the buyers will purchase the
producers and packers commodities.  The proposed amendment will
allow the Department to provide the services if they are not
available from the private sector or other entities.

FISCAL NOTE

The Department would charge fees only to those requesting the
services.
