|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 213 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO UNIFORM CONTROLLED SUBSTANCES; AMENDING CHAPTER 27, TITLE 37, 3 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 37-2731A, IDAHO CODE, TO 4 REQUIRE THAT PHARMACISTS DISPENSING RITALIN SHALL DISCLOSE TO THE PERSON 5 TAKING POSSESSION OF THE DISPENSED PRESCRIPTION KNOWN SIDE EFFECTS OF 6 PRESCRIPTIVE AND NONPRESCRIPTIVE USE OF THE DRUG AND OTHER CONSEQUENCES, 7 AND TO DIRECT THE BOARD OF PHARMACY TO PROMULGATE RULES TO ENSURE THAT THE 8 DISCLOSED INFORMATION IS PROVIDED BY THE DISPENSING PHARMACIST TO EACH 9 PERSON WHO TAKES POSSESSION OF A RITALIN PRESCRIPTION AND THAT SPECIFIED 10 INFORMATION IS CONSISTENT WITH THE MOST CURRENT MEDICAL FINDINGS. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Chapter 27, Title 37, Idaho Code, be, and the same is 13 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 14 ignated as Section 37-2731A, Idaho Code, and to read as follows: 15 37-2731A. DISCLOSURE ON DISPENSING RITALIN. (1) Any pharmacist as 16 defined in section 54-1705(22), Idaho Code, who dispenses the stimulant 17 methylphenidate, commonly known as ritalin, shall disclose, at the least, the 18 following information: 19 (a) Known side effects of prescriptive use of the drug include 20 tachycardia, dizziness, insomnia, depression, abdominal pain, anorexia, 21 loss of appetite, dry mouth and suppression of growth has been associated 22 with long-term use; 23 (b) Ingesting the tablet by any means other than swallowing can result in 24 severe reactions or complications such as blood clots, skin and circula- 25 tory problems, and even death; and 26 (c) No person who takes ritalin after the age of twelve (12) years is 27 eligible for military service. 28 (d) Distribution of the medication to any other person is a felony 29 offense in Idaho and is also a federal offense. 30 (2) The board is authorized and directed to promulgate rules to ensure 31 that the information in subsection (1) of this section is provided by the dis- 32 pensing pharmacist to each person who takes possession of a ritalin prescrip- 33 tion. In addition, the board is responsible for ensuring that the information 34 provided by the dispensing pharmacist is consistent with the most current med- 35 ical findings.
