That Section 1-1102, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 1-1102. OATH, BOND, SALARY AND EXPENSES -- COST OF LIVING ADJUSTMENTS. 15 (1) Said reporter shall take the oath required to be taken by the judicial 16 officers;andbe bonded to the state of Idaho in the form and manner pre- 17 scribed by chapter 8, title 59, Idaho Code; and holdhisoffice during the 18 pleasure of said judge, and shall receive an annual salary commencing on July191, 1989, according to the following schedule:. 20Years as Idaho DistrictAnnual21Court ReporterSalary220-1 (if hired after 7-1-89)$27,000231-2$28,505243-4$29,503255 or more$30,68326 The reporter's salary shall be paid on regular pay periods not less frequently 27 than monthly as determined by order of the supreme court.The supreme court28may, in its discretion, authorize a higher starting salary than that set forth29in subsection (1) of this section for any shorthand reporter who has been cer-30tified as either a certified shorthand reporter or registered public reporter31and who has previous court reporting experience in another state.32 (2)Commencing July 1, 1990, the chief justice of tThe supreme court 33 shall establish and maintain, consistent with the provisions of this section 34 and other applicable provisions of law, a personnel plan for district court 35 reporters governing their appointment, promotion, classification, minimum 36 qualifications, compensation and salary schedule, expenses, leave, transfer, 37 lay-off, removal, discipline and other incidents of employment of those dis- 38 trict court reporters. The salary schedule promulgated pursuant to the author- 39 ity conferred in this section shall beof temporary effect and must berati- 40 fied by the legislature through the appropriation process at the regular leg- 41 islative session first following its adoption. Any such salary schedule, or 42 portions thereof, not approved in the above manner shall be rejected, null and 2 1 void and of no force and effect on July 1 of the year,following submission of 2 such schedule to the legislature. Provided, however, that any such salary 3 schedule, or portions thereof, previously ratified by the legislature in the 4 manner provided for herein shall continue in full force and effect until modi- 5 fied in the manner provided for herein. To the extent possible, the personnel 6 plan shall recognize performance as measured by factors such as productivity, 7 reliability, effectiveness and longevity. 8 (3) There shall be paid in addition to said salary, to each of the court 9 reporters of the district courts, out of the state treasury, for each term of 10 district court held by the judge thereof, for the trial and disposition of 11 causes and the transaction of business under the laws of the state, in other 12 counties than that in which said court reporter resides, his actual and neces- 13 sary expenses for traveling and attending each term: provided, however, that 14 no stenographic reporter shall be paid his salary, or any portion thereof, 15 unless he shall have first taken and subscribed an oath that he has prepared 16 the transcript of the testimony on appeal either in a civil or criminal 17 action, or specified portion thereof, in the order in which the copy of the 18 order directing him to prepare the same has been served upon him: provided, 19 however, that the estimated cost of transcribing such transcript shall have 20 been paid to such reporter at the time of the service of the copy of the order 21 upon him.
REPRINT REPRINT REPRINT REPRINT REPRINT REPRINT STATEMENT OF PURPOSE RS10829 This bill amends section 1-1102, Idaho Code, relating to the compensation and expenses of court reporters, to clarify that the Supreme Court shall establish the annual salary of district court reporters in accordance with the present provisions in this statute which directs the Supreme Court to devise a personnel plan for reporters that covers their appointment, classification, minimum qualifications, compensation, and other incidents of employment. The annual salary set by the Supreme Court would be ratified by the Legislature through the appropriation process. At the request of the Legislature, the Idaho Supreme Court reactivated a court reporter committee in 1997 to consider a number of policy issues regarding court reporting in the Idaho Judiciary, including competency standards and an appropriate compensation structure. The compensation schedule tentatively adopted by the Supreme Court contemplates three categories of reporter compensation based on their level of competence in real-time reporting utilizing computer-aided translation. FISCAL NOTE A request for additional general funds in the amount of $95,900 for fiscal year 2002 has been made to the Joint Finance and Appropriations Committee to accommodate the annual salary schedule tentatively approved by the Supreme Court under the authority of this section of the code.
