SCHOOLS - SEX EDUCATION - Amends existing law relating to courses of
instruction in public schools to provide that, if a school district
introduces a program on family life and sex education, the content of the
instruction shall be determined solely at the local level; and to extend
the meaning of self-discipline to include abstinence as the only safe
method to combat unwanted pregnancy, HIV/AIDS and sexually transmitted

  1                                        AN ACT
  2    RELATING TO  COURSES  OF  INSTRUCTION  IN  PUBLIC  SCHOOLS;  AMENDING  SECTION
  3        33-1608,  IDAHO  CODE,  TO  PROVIDE THAT IF A SCHOOL DISTRICT INTRODUCES A
  4        PROGRAM ON FAMILY LIFE AND SEX EDUCATION, THE CONTENT OF THAT  INSTRUCTION
  5        SHALL BE DETERMINED SOLELY AT THE LOCAL LEVEL AND TO EXTEND THE MEANING OF
  6        SELF-DISCIPLINE  TO  INCLUDE  ABSTINENCE AS THE ONLY SAFE METHOD TO COMBAT
  7        UNWANTED PREGNANCY, HIV/AIDS AND SEXUALLY TRANSMITTED DISEASES.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 33-1608, Idaho Code, be, and the same  is  hereby
 10    amended to read as follows:
                                                                        
 11        33-1608.  FAMILY  LIFE AND SEX EDUCATION -- LEGISLATIVE POLICY. The legis-
 12    lature of the state of Idaho believes that the primary responsibility for fam-
 13    ily life and sex education, including moral  responsibility,  rests  upon  the
 14    home  and  the church and the schools can only complement and supplement those
 15    standards which are established in the family. The decision as to  whether  or
 16    not  any  program  in family life and sex education is to be introduced in the
 17    schools is a matter for determination at the local district level by the local
 18    school board of duly selected representatives of the people of the  community.
 19    The  content of instruction in human sexuality and family life shall be deter-
 20    mined solely at the local level. If such program is adopted,  the  legislature
 21    believes that:
 22        a.  Major  emphasis in such a program should be to assist the home in giv-
 23    ing them the knowledge and appreciation of the important place the family home
 24    holds in the social system of our culture, its place in  the  family  and  the
 25    responsibility  which  will  be there much later when they establish their own
 26    families.
 27        b.  The program should supplement the work in the home and the  church  in
 28    giving  youth  the scientific, physiological information for understanding sex
 29    and its relation to the miracle of life, including knowledge of the  power  of
 30    the  sex drive and the necessity of controlling that drive by self-discipline,
 31    meaning abstinence is the only  safe  method  to  combat  unwanted  pregnancy,
 32    HIV/AIDS and sexually transmitted diseases.
 33        c.  The  program  should  focus upon helping youth acquire a background of
 34    ideals and standards and attitudes which will be of value to him now and later
 35    when he chooses a mate and establishes his own family.

                      STATEMENT OF PURPOSE
                            RS 10953

The purpose of this legislation is to provide that if a School
District introduces a program on family life and sex education, the
content of that instruction shall be determined solely at the local
level and to extend the meaning of self-discipline to include
abstinence as the only safe method of combat unwanted pregnancy,
HIV/aids and sexually transmitted diseases.
