|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 292 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO EDUCATION OF STUDENTS IN JUVENILE DETENTION FACILITIES; AMENDING 3 SECTION 33-1002B, IDAHO CODE, TO PROVIDE THAT SCHOOL DISTRICTS WHICH EDU- 4 CATE STUDENTS IN A JUVENILE DETENTION FACILITY WITH A SUMMER SCHOOL PRO- 5 GRAM SHALL BE ELIGIBLE FOR A TUITION-EQUIVALENCY ALLOWANCE IN ADDITION TO 6 SUPPORT UNIT FUNDING; AMENDING SECTION 33-1002C, IDAHO CODE, TO PROVIDE 7 THAT SCHOOL DISTRICTS WHICH EDUCATE STUDENTS IN A JUVENILE DETENTION 8 FACILITY MAY ESTABLISH A SUMMER SCHOOL PROGRAM WHICH SHALL BE INCLUDED IN 9 THE CALCULATION OF THE DISTRICT'S EXCEPTIONAL EDUCATION SUPPORT UNITS; AND 10 DECLARING AN EMERGENCY. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Section 33-1002B, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 33-1002B. PUPIL TUITION-EQUIVALENCY ALLOWANCES. 1. Districts which edu- 15 cate pupils placed by Idaho court order in licensed group homes, agencies, 16 institutions or juvenile detention facilities shall be eligible for an allow- 17 ance equivalent to the previous year's certified local annual tuition rate per 18 pupil calculated on a daily basis. This district allowance shall be in addi- 19 tion to support unit funding and included in district apportionment payments, 20 subject to approval of district applications by the state superintendent of 21 public instruction. 22 2. Districts which educate pupils placed by Idaho court order in a juve- 23 nile detention facility with a summer school program shall be eligible for an 24 allowance equivalent to one half (1/2) of the previous year's local annual 25 tuition rate per pupil calculated on a daily basis. This district allowance 26 shall be in addition to support unit funding and included in district appor- 27 tionment payments, subject to approval of district applications by the state 28 superintendent of public instruction. 29 3. Districts which educate school age special education students who, due 30 to the nature and severity of their disabilities are residing in licensed pub- 31 lic or private residential facilities or homes, and whose parents are not 32 patrons of the district, shall be eligible for an allowance equivalent to the 33 previous year's certified local annual tuition rate per child plus the excess 34 cost rate that is annually determined by the state superintendent of public 35 instruction. This district allowance shall be in addition to exceptional edu- 36 cation support unit funding and included in district apportionment payments, 37 subject to approval of district applications by the state superintendent of 38 public instruction. 39 SECTION 2. That Section 33-1002C, Idaho Code, be, and the same is hereby 40 amended to read as follows: 41 33-1002C.ALTERNATIVE SECONDARY SCHOOLSUMMER SCHOOL PROGRAM SUPPORT 2 1 UNITS -- ALTERNATIVE SECONDARY SCHOOL -- JUVENILE DETENTION FACILITY. 2 (1) Alternative secondary schools approved by the state board of education 3 may establish a summer school program of not less than two hundred twenty-five 4 (225) hours of instruction which shall be included in the educational support 5 units calculated as provided in section 33-1002, Idaho Code. The average daily 6 attendance divided by forty (40) shall determine the number of allowable sup- 7 port units which shall be included in the alternative school secondary support 8 units calculated for the school district for the succeeding school term. 9 (2) Districts which educate pupils placed by court order in a juvenile 10 detention facility may establish a summer school program which shall be 11 included in the educational support units calculated as provided in section 12 33-1002, Idaho Code. The average daily attendance divided by forty (40) shall 13 determine the number of allowable support units which shall be included in the 14 exceptional education school support units calculated for the school district 15 for the succeeding school term. 16 SECTION 3. An emergency existing therefor, which emergency is hereby 17 declared to exist, this act shall be in full force and effect on and after its 18 passage and approval.
STATEMENT OF PURPOSE RS 10766C1 Juveniles placed in state institutions today receive twelve months of educational instruction. However, the county juvenile centers are currently receiving only nine months of instruction due to the organization of the school year. This bill would provide funding on a twelve month period. Payments will be made using average daily attendance as the funding tool. FISCAL IMPACT Requirements for 11 county centers will require approximately 20 teachers and 18 aides plus supplies for a total of approximately $225,000.
