|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 308 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO CITY IRRIGATION SYSTEMS; AMENDING SECTION 50-1807, IDAHO CODE, TO 3 CLARIFY THE PROVISIONS GOVERNING THE DATE FOR MAKING AN ESTIMATE OF THE 4 EXPENSES FOR THE SYSTEM FOR PURPOSES OF ASSESSMENTS AND TO MAKE TECHNICAL 5 CORRECTIONS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 50-1807, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 50-1807. LEVYING OF ANNUAL ASSESSMENTS TO DEFRAY OPERATING AND MAINTE- 10 NANCE COSTS. The clerk of such city which shall acquire and operate a city 11 irrigation system under sections 50-1801 through 50-1835, Idaho Code, shall 12 act as the assessor of such irrigation system and shall, on or before the4th13 fourth Monday of January of each year, prepare an assessment book containing a 14 full and accurate list and description of all of the lots, parcels, pieces and 15 tracts of land within the boundaries of such city irrigation system to which 16 irrigation water is being supplied by such system, and a list of the persons 17 who own, claim or have in possession or control thereof during said year, giv- 18 ing the number of acres in the unplatted portion of such city and the number 19 of the lots and blocks within the boundaries of such city irrigation system 20 listed to each person. The mayor and council of such city shall, on or before 21 the secondMondayWednesday of February of each year, unless a legal holiday,22then on the next succeeding work day, meet and make an estimate of the neces- 23 sary funds for the expenses of maintaining, operating, improving, extending 24 and enlarging said city irrigation system for theensuing calendarcurrent 25 fiscal year. Said estimate shall also include a reasonable sum not to exceed 26 tenper centpercent (10%) of the total estimate for anticipated unpaid and 27 delinquent taxes and such sum as may be necessary to retire outstanding war- 28 rants, indebtedness, sinking funds, bonds and interest of a city irrigation 29 system, and shall spread the same upon their minutes and shall thereupon 30 apportion to each lot, piece or parcel of land within theboundiariesbound- 31 aries of such irrigation system in proportion to the benefits received by such 32 lot, piece or parcel of land growing out of the maintenance and operation of 33 such irrigation system. Such assessment shall be immediately carried out by 34 the city clerk and entered under appropriate columns on the assessment roll. 35 Said assessment roll shall contain an appropriate column for each item 36 assessed and shall be subject to review by the mayor and council of the city 37 as hereinafter provided. On or before the1stfirst day of March of each year 38 the city clerk must give notice of the time the mayor and council shall meet 39 to correct the assessments so made; said notice shall be published twice at 40 intervals of not less than six (6) days in the official newspaper to give 41 notice when the mayor and council will meet to correct such assessments so 42 levied and assessed as herein provided. The time fixed for such meeting shall 43 not be later than the20thtwentieth day of March of each year and in the 2 1 meantime the assessment books shall remain in the office of the city clerk for 2 the inspection of any person interested.
STATEMENT OF PURPOSE RS11134C1 Current law requires that municipal irrigation assessments be set on the second Monday of February. Often, this requires a special called meeting.This legislation would allow municipal irrigation assessments to be set on or before the second Wednesday of February, which would enable the city council to set assessments at a regularly scheduled meeting. FISCAL IMPACT Would result in a modest saving of city funds by not having to have a special called meeting. Contact: Rep.
