  1                                        AN ACT
  2    RELATING TO TECHNOLOGICAL INSTRUCTION; AMENDING SECTION 33-1003C, IDAHO  CODE,
  3        TO PROVIDE FOR CONTINUING TECHNOLOGICAL INSTRUCTION BY SPECIAL APPLICATION
  4        OF THE SCHOOL FOUNDATION PROGRAM.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That Section 33-1003C, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        33-1003C.  SPECIAL  APPLICATION  --  TECHNOLOGICAL  INSTRUCTION.  For  the
  9    school years 1998-99, 1999-2000 and 2000-2001, iIn order to acquire and  main-
 10    tain technology for individualized computer and/or distance learning programs,
 11    a school district may use students' documented contact hours on individualized
 12    computer education or distance learning programs in determining the district's
 13    average  daily attendance, whether the student is actually in the computer lab
 14    or distance learning center, or has logged on to  the  computer  from  another
 15    location. A district's technology instruction programs shall be subject to the
 16    following provisions:
 17        (1)  The  certification  requirements  for an alternative school using the
 18    individualized computer education or distance learning program may be  met  by
 19    having  a  properly  certificated  teacher  available on a consultant tutorial
 20    basis. The consultant tutors will be available by telephone, fax,  e-mail,  or
 21    in person at the school site on a daily basis.
 22        (2)  Districts  claiming average daily attendance pursuant to this section
 23    shall submit annual evaluations of the program to the state  board  of  educa-
 24    tion.
 25        (3)  Districts  may  offer  individualized  computer education or distance
 26    learning programs on a  calendar  which  may  differ  from  the  rest  of  the
 27    district's instruction, but in no case may a district claim more average daily
 28    attendance  for  a student than the full-time equivalency of a regular term of
 29    attendance for a single student.
 30        (4)  Nonalternative high school students may receive  individualized  com-
 31    puter  education or distance learning instruction and credit through an alter-
 32    native school site.

The purpose of this legislation is to provide on-going

opportunities for Idaho students to participate in

individualized computer and/or distance learning programs by

removing the sunset on the pilot program.
          
    
          
          
          
                          FISCAL IMPACT
          
No fiscal impact is expected to the general fund since this
