|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 327 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO SELF-FUNDED HEALTH CARE PLANS; AMENDING SECTION 41-4003, IDAHO 3 CODE, TO EXEMPT COUNTIES OF THIS STATE FROM REGISTRATION REQUIREMENTS AND 4 TO MAKE TECHNICAL CORRECTIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 41-4003, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 41-4003. REGISTRATION REQUIRED -- EXEMPTIONS -- NOT SUBJECT TO INSURANCE 9 CODE. (1) No self-funded plan shall operate in this state except while regis- 10 tered with the director as hereinafter provided. Self-funded plans already in 11 operation at the effective date of this act shall so register within ninety 12 (90) days after such effective date. 13 (2) No registration shall be required of: 14 (a) Any self-funded plan established for the sole purpose of funding the 15 dollar amount of a deductible clause contained in the provisions of an 16 insurance contract issued by an insurer duly authorized to transact dis- 17 ability insurance in this state if the deductible does not exceed an 18 amount applicable to each beneficiary of five hundred dollars ($500) per 19 annum and the total of all obligations to all beneficiaries insured under 20 the plan arising out of the application of such a deductible does not 21 exceed the aggregate amount of fifty thousand dollars ($50,000) in any one 22 (1) year. 23 (b) Any plan established and maintained for the purpose of complying with 24 anyWworkmen'sCcompensationLlaw orUunemploymentCcompensation 25DdisabilityIinsuranceLlaw. 26 (c) Any plan administered by or for the federal government or agency 27 thereof or any county of this state. 28 (d) Any plan which is primarily for the purpose of providing first aid 29 care and treatment, at a dispensary of an employer, for injury or sickness 30 of employees while engaged in their employment. 31 (e) Any employer's self-insured health plan or service established and 32 maintained solely for its members and their immediate families, or to any 33 self-insured health plan or service established, maintained, and insured 34 jointly by any employer and any labor organization or organizations if 35 such health plan or service has been in existence and operation for fif- 36 teen (15) years immediately preceding the effective date of this act. 37 (3) Plans while so registered shall not be deemed to be engaged in the 38 business of insurance and shall not be subject to provisions of the Idaho 39IinsuranceCcode except as expressly provided in this act.
STATEMENT OF PURPOSE RS 11059 This legislation would allow county governments that elect to provide employee medical benefits through a self-funded plan to manage that plan pursuant to state laws currently governing all other county functions, and thereby allow trust funds to be invested with county funds at large, rather than separately. This subjects the trust fund to county check and balances, and results in greater yields from trust investments. FISCAL IMPACT The State will realize a cost and labor savings to the extent it will not be required to register counties who opt to utilize self-funded medical trusts to provide medical benefits to their employees.
