ENDOWMENT LANDS - Adds to existing law to provide for an exchange of
certain endowment lands, managed by the State Board of Land Commissioners,
which are adjacent to the Idaho State University/University of Idaho Center
for Higher Education in Idaho Falls, Idaho, with lands of equivalent market
value owned by the State Board of Education; and to provide intent of the
Legislature to facilitate the land exchange by including moneys in the
State Board of Education's General Fund appropriation for fiscal year 2002

  2    RELATING  TO  ACQUIRING  SPECIFIED  ENDOWMENT  LANDS  FOR  THE   IDAHO   STATE
  3        UNIVERSITY/UNIVERSITY OF IDAHO CENTER FOR HIGHER EDUCATION IN IDAHO FALLS,
  4        IDAHO;  AMENDING CHAPTER 1, TITLE 58, IDAHO CODE, BY THE ADDITION OF A NEW
  5        SECTION 58-156, IDAHO CODE, TO PROVIDE LEGISLATIVE FINDINGS AND  PURPOSES,
  6        TO  DESCRIBE  CERTAIN  ENDOWMENT LANDS LOCATED ADJACENT TO THE IDAHO STATE
  7        UNIVERSITY/UNIVERSITY OF IDAHO CENTER FOR HIGHER EDUCATION IN IDAHO FALLS,
  8        IDAHO, TO ACKNOWLEDGE THE STATE BOARD OF  EDUCATION'S  MANAGEMENT  OF  THE
  9        IDAHO  STATE UNIVERSITY/UNIVERSITY OF IDAHO CENTER FOR HIGHER EDUCATION IN
 10        IDAHO FALLS, IDAHO, TO ACKNOWLEDGE THAT THE LANDS ARE HELD IN TRUST BY THE
 11        STATE BOARD OF LAND COMMISSIONERS, TO PROVIDE THAT THE STATE BOARD OF LAND
 12        COMMISSIONERS SHALL RECEIVE TITLE TO REAL  PROPERTY  OF  EQUIVALENT  VALUE
 13        THROUGH  LAND  EXCHANGE,  TO  PROVIDE  LEGISLATIVE APPROVAL OF SUCH A LAND
 14        EXCHANGE, TO ACKNOWLEDGE THAT THE STATE BOARD OF EDUCATION AND  THE  STATE
 15        BOARD OF LAND COMMISSIONERS HAVE AGREED TO ENTER INTO A CONTRACT TO EFFECT
 16        THE  LAND EXCHANGE, TO PROVIDE THAT THE STATE BOARD OF EDUCATION SHALL PAY
 17        FOR ALL COSTS OF THE TRANSACTION AND TO PROVIDE THAT IT IS THE  INTENT  OF
 18        THE LEGISLATURE TO PROVIDE FUNDS FOR THE DESCRIBED LAND EXCHANGE.
                                                                        
 19    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 20        SECTION  1.  That  Chapter  1,  Title  58, Idaho Code, be, and the same is
 21    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 22    ignated as Section 58-156, Idaho Code, and to read as follows:
                                                                        
 23        58-156.  LEGISLATIVE  FINDINGS AND PURPOSES.  The legislature of the state
 24    of Idaho finds:
 25        (1)  That the following described tracts of public school endowment  land,
 26    containing nineteen and twenty-seven one-hundredths (19.27) acres of endowment
 27    land,  more  or  less,  managed  by the state board of land commissioners, are
 28    located adjacent to the Idaho State University/University of Idaho Center  for
 29    Higher  Education  in  Idaho Falls, Idaho, in Township 2 North, Range 37 East,
 30    B.M., Bonneville County:
 31        (a)  Lot 9, Pt. NW1/4 NE1/4, Pt. NE1/4 NW1/4,  containing  six  and  four-
 32        tenths (6.4) acres;
 33        (b)  Lot  10,  Pt.  SW1/4  NE1/4,  Pt.  SE1/4 NW1/4, containing twelve and
 34        eighty-seven one-hundredths (12.87) acres.
 35        (2)  That Idaho State  University  and  the  University  of  Idaho,  their
 36    respective  foundations,  and  the state board of education own and manage the
 37    Center for Higher Education in Idaho Falls, Idaho, and the state board of edu-
 38    cation has expressed its desire to obtain and manage the described parcels  of
 39    endowment  land  as  part  of  the Center for Higher Education in Idaho Falls,
 40    Idaho;
 41        (3)  That the endowment lands are held in trust by the state board of land
 42    commissioners and are managed to  generate  the  maximum  long-term  financial
 43    returns to the public school endowment;

  1        (4)  That  any  transaction in which the state board of education acquires
  2    title to these endowment lands, the state board of  land  commissioners  shall
  3    receive  title  to  real  property  of  equivalent  market  value through land
  4    exchange;
  5        (5)  That the legislature approves of a course  of  action  by  which  the
  6    state  board  of education on behalf of Idaho State University and the Univer-
  7    sity of Idaho acquires the described endowment lands now owned  by  the  state
  8    board  of land commissioners, through land exchange at not less than fair mar-
  9    ket value, as determined by qualified appraisals;
 10        (6)  That the state board of education and the state board of land commis-
 11    sioners have agreed to enter into a contract by which the state board of  edu-
 12    cation may acquire the described endowment lands, through land exchange at not
 13    less than fair market value, as determined by qualified appraisals;
 14        (7)  That  any acquisition by the state board of education of title to the
 15    described endowment lands shall be subject to any outstanding rights and  res-
 16    ervations  of  record, and the state board of education shall pay all costs of
 17    the transactions including, but not limited to, surveys and appraisals.
 18        (8)  It is the intent  of  the  legislature  to  provide  funds  for  this
 19    exchange to the state board of education within the state board of education's
 20    general fund appropriation for fiscal year 2002, to facilitate the state board
 21    of education, on behalf of Idaho State University and the University of Idaho,
 22    to  purchase real property of equivalent market value and to enter into a land
 23    exchange with the state board of land commissioners to  acquire  the  nineteen
 24    and  twenty-seven  one-hundredths  (19.27)  acres,  more or less, of endowment
 25    lands.

Statement of Purpose / Fiscal Impact


        

                   STATEMENT OF PURPOSE

This legislation authorizes the Department of Lands to exchange

land from the public school endowment lands (the two particular

parcels are adjacent to the Center for Higher Education in Idaho

Falls) for land of equivalent market value owned by the State

Board of Education on behalf of Idaho State University and the

University of Idaho. The two parcels of endowment property total

19.27 acres, more or less, and have a combined value of

approximately $500,000. The State Board of Education intends

that the land will become part of the campus of the Center for

Higher Education in Idaho Falls that currently includes two

classroom buildings, a student union building and a soon-to-be-

constructed laboratory building called the Center for Science and

Technology.
        
        
        
                         FISCAL IMPACT
        
The Legislature will be asked to appropriate $500,000 in one-time

funds as part of the State Board of Education's FY 2002 general
