  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
  3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE WORKER'S COM-
  4        PENSATION SYSTEM IN THE STATE OF IDAHO.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS, the worker's compensation system in the state of Idaho was  first
  7    enacted by the 1917 Legislature and was the first of the so-called social jus-
  8    tice acts which embody a fundamental legal concept entirely different from the
  9    common law;
 10        WHEREAS, at the time the system was implemented, the workforce was heavily
 11    resource-based;
 12        WHEREAS, the laws on worker's compensation have been repeatedly amended in
 13    an effort to maintain consistency with the prevailing practices and procedures
 14    of the day;
 15        WHEREAS,  times  have  changed  and  the distribution of the workforce has
 16    moved steadily away from agriculture, mining and logging and is now more  ser-
 17    vice and technology oriented;
 18        WHEREAS,  it  becomes  more  imperative to ensure that there is a fair and
 19    equitable collection of contributions from employers and distribution of bene-
 20    fits to claimants;
 21        WHEREAS, worker's compensation laws were last recodified thirty years ago;
 22        WHEREAS, since that recodification inequities have again arisen  and  con-
 23    tinue to be perpetuated;
 24        WHEREAS, the time has come to review the system in its entirety, to objec-
 25    tively  scrutinize  procedures,  practices, contributions and benefits, and to
 26    examine unintended results which have emerged over time and  through  multiple
 27    amendments to this law.
 28        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 29    of  the  Fifty-sixth  Idaho  Legislature, the House of Representatives and the
 30    Senate concurring therein, that  the  Legislative  Council  is  authorized  to
 31    appoint  a committee to undertake and complete a study of the state's worker's
 32    compensation system as codified in Title 72 of the Idaho Code. The Legislative
 33    Council shall determine the number of legislators  and  membership  from  each
 34    house  appointed to the committee and shall authorize the committee to receive
 35    input, advice and assistance from interested and affected parties who are  not
 36    members of the legislature.
 37        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
 38    appointed  by  the cochairs of the committee who are appointed by the Legisla-
 39    tive Council. Nonlegislative members of the advisory committee  shall  not  be
 40    reimbursed  from legislative funds for per diem, mileage or other expenses and
 41    shall not have voting privileges regarding the committee's recommendations  or
 42    proposed legislation.
 43        BE  IT FURTHER RESOLVED that the committee shall report its findings, rec-
 44    ommendations and proposed legislation, if any, to the Second  Regular  Session

  STATEMENT OF PURPOSE
                                
                            RS 11033
 This Bill authorizes the Legislative Council to appoint a
committee to study the Worker's Compensation System.  It has been
thirty years since these laws were re-codified.  This study will
look at changes that have taken place in the workplace and the
multiple amendments to the Worker's Compensation Laws.  The intent
is to making the System better for workers and everyone else
involved in the System.
