  1                                   A JOINT MEMORIAL
  2    TO THE PRESIDENT, SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES  IN
  3        CONGRESS  ASSEMBLED,  AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE
  4        STATE OF IDAHO IN THE CONGRESS OF THE UNITED STATES.
                                                                        
  5        We, your Memorialists, the House of Representatives and the Senate of  the
  6    State of Idaho assembled in the First Regular Session of the Fifty-sixth Idaho
  7    Legislature, do hereby respectfully represent that:
                                                                        
  8        WHEREAS,  the  expansion  of the Craters of the Moon National Monument was
  9    imposed by Presidential Proclamation on November 9, 2000. The exterior  bound-
 10    ary  of  the expansion encompasses over 673,000 acres, with some 410,000 acres
 11    to be managed by the National Park Service. Except for some non-federal lands,
 12    the Bureau of Land Management will manage the remaining acreage; and
 13        WHEREAS, the area to be managed by the National Park  Service  was  tradi-
 14    tionally open to hunting; and
 15        WHEREAS, relevant language in the proclamation states:
 16    "Nothing  in  this  proclamation  shall  be  deemed to enlarge or diminish the
 17    jurisdiction of the State of Idaho with respect to fish and  wildlife  manage-
 18    ment"; and
 19        WHEREAS,  the  National Park Service administered portion of the expansion
 20    is intended by that agency to be closed to hunting  in  contradiction  of  the
 21    specific language of the November 9th proclamation; and
 22        WHEREAS,  we  find  no  provisions  that allow the administering agency to
 23    ignore the terms of the proclamation, and the Idaho Fish and  Game  Commission
 24    must  finalize  its  annual big game hunting rules and publicize said rules in
 25    March of this year; and
 26        WHEREAS, the Governor of the State of Idaho, with the support of the Idaho
 27    Fish and Game Commission, has conveyed his deep concern by letter dated  Janu-
 28    ary 31, 2001, to the Secretary of the Interior; and
 29        WHEREAS,  it is imperative that the National Park Service cease efforts to
 30    close the lands within the expanded monument to hunting and that the state  of
 31    Idaho be able to continue to manage unimpeded the wildlife therein as provided
 32    in the Presidential Proclamation; and
 33        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 34    of  the  Fifty-sixth  Idaho  Legislature, the House of Representatives and the
 35    Senate concurring therein, that we respectfully request that the President  of
 36    the  United States direct the National Park Service to promptly and fully com-
 37    ply with the provision of the Presidential Proclamation cited herein and cease
 38    and desist its efforts to close lands within the expanded Monument to hunting.
 39        BE IT FURTHER RESOLVED that the Chief Clerk of the  House  of  Representa-
 40    tives  be, and she is hereby authorized and directed to forward a copy of this
 41    Memorial to the President of the United States, the Secretary of the Interior,
 42    the President of the Senate and the Speaker of the House of Representatives of
 43    Congress, and the congressional delegation representing the State of Idaho  in
 44    the Congress of the United States.

     A memorial opposing the closure of certain lands within the
expanded Craters of the Moon (Great Rift) National Monument to
hunting.
