|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1072 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO THE COMPREHENSIVE PRIMARY AND PREVENTIVE CARE GRANT PROGRAM; 3 AMENDING TITLE 39, IDAHO CODE, BY THE ADDITION OF A NEW CHAPTER 82, TITLE 4 39, IDAHO CODE, TO DEFINE TERMS, TO ESTABLISH THE IDAHO COMPREHENSIVE PRI- 5 MARY AND PREVENTIVE CARE GRANT PROGRAM, TO PROVIDE FOR SERVICE GRANT 6 APPLICATIONS AND AWARDS, PERMISSIBLE USES OF SERVICE GRANT MONEYS AND TO 7 PROVIDE FOR ANNUAL REPORTS, TO PROVIDE FOR AN ADVISORY COUNCIL, TO PROVIDE 8 FOR THE CREATION OF THE COMPREHENSIVE PRIMARY AND PREVENTIVE CARE FUND AND 9 TO PROVIDE FOR DUTIES OF THE DEPARTMENT OF HEALTH AND WELFARE. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Title 39, Idaho Code, be, and the same is hereby amended 12 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap- 13 ter 82, Title 39, Idaho Code, and to read as follows: 14 CHAPTER 82 15 IDAHO COMPREHENSIVE PRIMARY AND PREVENTIVE CARE GRANT PROGRAM 16 39-8201. DEFINITIONS. As used in this chapter: 17 (1) "Comprehensive primary care" means the basic entry level of health 18 care provided by health care practitioners or nonphysician health care practi- 19 tioners which is generally provided in an outpatient setting. At a minimum, 20 comprehensive primary care includes providing or arranging for the provision 21 of the following services: primary health care; maternity care, including 22 prenatal care; preventive, developmental and diagnostic services for infants 23 and children; adult preventive services; diagnostic laboratory and radiology 24 services; emergency care for minor trauma; pharmaceutical services; and coor- 25 dination and follow-up for hospital care. Comprehensive primary care may also 26 include optional services based on a patient's needs. 27 (2) "Department" means the Idaho department of health and welfare. 28 (3) "Idaho qualified health center" means an entity which provides com- 29 prehensive primary care services and which: 30 (a) Accepts all patients despite a patient's ability to pay; 31 (b) Uses a sliding fee schedule for payments; 32 (c) Has a community board of directors, the majority of whom are users of 33 such centers; 34 (d) Serves a designated medically underserved area or population, as pro- 35 vided in section 330(b) of the federal public health service act, 42 36 U.S.C. section 254b; 37 (e) Has a demonstrated record of providing cost-effective care; and 38 (f) Provides or arranges for the provision of comprehensive primary care 39 services to persons of all ages. 40 (4) "Medically underserved area" means an area designated by the secre- 41 tary of the United States department of health and human services as an area 42 with a shortage of health care professionals or health services. 2 1 (5) "Medically underserved population" means a population group desig- 2 nated by the secretary of the United States department of health and human 3 services as having a shortage of health care professionals or health services. 4 (6) "Program" means the Idaho comprehensive primary and preventive care 5 grant program as provided for in this chapter. 6 (7) "Service grant" means a grant by the department to an Idaho qualified 7 health center in accordance with this chapter. 8 (8) "Uninsured or medically indigent patient" means a patient receiving 9 services from an Idaho qualified health center: 10 (a) Who is not eligible for medicaid, medicare or any other type of gov- 11 ernmental health insurance; 12 (b) Who is not receiving third-party payments through an employer for 13 health care costs; and 14 (c) Whose household income, as defined in section 63-701, Idaho Code, is 15 below two hundred percent (200%) of the federal poverty level. 16 39-8202. IDAHO COMPREHENSIVE PRIMARY AND PREVENTIVE CARE GRANT PROGRAM 17 ESTABLISHED. The "Idaho Comprehensive Primary and Preventive Care Grant Pro- 18 gram" is hereby established, under the direction and administration of the 19 department, for the purpose of making service grants to Idaho qualified health 20 centers for their use in providing care to uninsured or medically indigent 21 patients in Idaho. The program shall be established with such state funds as 22 may be appropriated annually by the legislature. 23 39-8203. SERVICE GRANT APPLICATIONS AND AWARDS -- USES OF SERVICE GRANT 24 MONEYS -- ANNUAL REPORTS. (1) Any Idaho qualified health center, as defined in 25 section 39-8201, Idaho Code, desiring to participate in the program shall make 26 application for a service grant to the department in a form prescribed by the 27 department. All applications shall be submitted and reviewed in accordance 28 with the provisions of grant procedures, criteria and standards promulgated by 29 rule by the department. All service grants shall be awarded within thirty (30) 30 days after approval by the department. 31 (2) Service grants awarded to Idaho qualified health centers shall only 32 be used by such centers to: 33 (a) Increase access to comprehensive primary care services to uninsured 34 or medically indigent patients who are served by such centers; 35 (b) Create new services or augment existing services provided to unin- 36 sured or medically indigent patients; or 37 (c) Establish new center sites that offer comprehensive primary care ser- 38 vices in medically underserved areas of the state or to medically 39 underserved populations. 40 (3) Grants received by Idaho qualified health centers pursuant to this 41 chapter shall not be used: 42 (a) To replace federal funds traditionally received by such centers, but 43 may be used to supplement such federal funds; 44 (b) For land or real estate investment; or 45 (c) To finance or satisfy any existing debt. 46 (4) No later than December 1 of each year, an Idaho qualified health cen- 47 ter receiving a service grant shall provide an annual report to the department 48 which details the number of additional uninsured and medically indigent 49 patients that are cared for and the types of services that are provided. 50 39-8204. ADVISORY COUNCIL. (1) There shall be an advisory council in the 51 department to review and make recommendations to the department regarding the 52 awarding of service grants to Idaho qualified health centers. The advisory 3 1 council shall be composed of eight (8) members, appointed by the director of 2 the department of health and welfare with consideration given for geographic 3 representation of the state, and consisting of the following members: 4 (a) One (1) employee of the department who is knowledgeable in primary 5 and preventive health care issues; 6 (b) One (1) employee of the department who is knowledgeable in medical 7 assistance issues; 8 (c) One (1) representative of a nonprofit organization representing pri- 9 mary health care providers; 10 (d) One (1) representative of an Idaho qualified health center; 11 (e) One (1) health care provider who has training and expertise in pro- 12 viding comprehensive primary care services to medically underserved popu- 13 lations and who is not affiliated with an Idaho qualified health center; 14 (f) Two (2) consumers who currently receive health care services from an 15 Idaho qualified health center; and 16 (g) One (1) rural hospital administrator. 17 (2) Appointments to the advisory council shall be for three (3) years. 18 Council members may be reappointed at the end of each three (3) year period. 19 Initial appointments shall be staggered in such a manner that approximately 20 one-third (1/3) are appointed for one (1) year, one-third (1/3) are appointed 21 for two (2) years, and one-third (1/3) are appointed for three (3) years. 22 (3) Members of the advisory council shall serve and shall be compensated 23 as provided by section 59-509(b), Idaho Code. 24 39-8205. IDAHO COMPREHENSIVE PRIMARY AND PREVENTIVE CARE FUND CREATED. 25 There is hereby created in the state treasury a fund to be known as the "Idaho 26 Comprehensive Primary and Preventive Care Fund." Moneys in the fund may be 27 expended pursuant to appropriation by the legislature, and may be utilized for 28 service grants and for the payment of program administrative costs which are 29 reasonably incurred by the department. Moneys in the fund may consist of 30 appropriations, contributions, grants, gifts, bequests or other sources 31 received. All interest from idle moneys in the fund shall be returned to the 32 fund. Any unexpended balance in the fund at the end of each fiscal year shall 33 remain in the fund. 34 39-8206. DUTIES OF THE DEPARTMENT. The department shall: 35 (1) Promulgate rules and forms to govern grant applications and awards; 36 (2) Develop a plan to ensure that grants are equitably distributed among 37 all Idaho qualified health centers; and 38 (3) Develop audits to assure that grant moneys are used to provide and 39 expand care to uninsured and medically indigent patients.
STATEMENT OF PURPQSE RS 10940 This legislation would create the Idaho Comprehensive Primary and Preventive Care Grant Program that would provide money to Idaho qualified health centers located in medically underserved areas to treat uninsured patients. The service grants could be used to 1). increase access to comprehensive primary care services for uninsured people, 2) create new services or augment existing services provided to uninsured patients, and 3) establish new center sites that offer comprehensive primary care services in medically underserved areas of the state or to medically underserved populations. The grant program would be administratively housed in the Idaho Department of Health & Welfare. The legislation creates an Advisory Board that would make recommendations about grant implementation to the department. In addition, the legislation provides for an annual reporting of grant expenditures which details the number of additional uninsured patients that are cared for and the types of services provided. FISCAL NOTE An appropriation of $4 million from the state general fund would provide approximately 50,000 primary care visits to 15,625 uninsured Idahoans. The use of Idaho qualified health centers as medical homes for these patients could reduce the impact on both the county indigent programs and the Catastrophic Health Care Fund for treatment of the chronically ill. The estimated cost of the semi-annual advisory board meetings is $2,000 and will be deducted from the appropriation.
