|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1075 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402, 3 IDAHO CODE, TO PROVIDE A CORRECT REFERENCE; AMENDING CHAPTER 4, TITLE 49, 4 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-420A, IDAHO CODE, TO 5 ESTABLISH AN IDAHO STATE CAPITOL COMMISSION LICENSE PLATE PROGRAM; AND 6 PROVIDING AN EFFECTIVE DATE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup 11 truck and each other motor vehicle having a maximum gross weight not in excess 12 of eight thousand (8,000) pounds shall be: 13 Vehicles one (1) and two (2) years old ............................ $48.00 14 Vehicles three (3) and four (4) years old ......................... $36.00 15 Vehicles five (5) and six (6) years old ........................... $36.00 16 Vehicles seven (7) and eight (8) years old ........................ $24.00 17 Vehicles over eight (8) years old ................................. $24.00 18 There shall be twelve (12) registration periods, starting in January for 19 holders of validation registration stickers numbered 1, and proceeding consec- 20 utively through December for holders of validation registration stickers num- 21 bered 12, each of which shall start on the first day of a calendar month and 22 end on the last day of the twelfth month from the first day of the beginning 23 month. Registration periods shall expire midnight on the last day of the reg- 24 istration period in the year designated by the validation registration 25 sticker. The numeral digit on the validation registration stickers shall, as 26 does the registration card, fix the registration period under the staggered 27 plate system of Idaho for the purpose of reregistration and notice of expira- 28 tion. 29 A vehicle that has once been registered for any of the above designated 30 periods shall, upon reregistration, be registered for the period bearing the 31 same number, and the registration card shall show and be the exclusive proof 32 of the expiration date of registration and licensing. Vehicles may be ini- 33 tially registered for less than a twelve (12) month period, or for more than a 34 twelve (12) month period, and the fee prorated on a monthly basis if the frac- 35 tional registration tends to fulfill the purpose of the monthly series regis- 36 tration system. 37 (2) For all school buses operated either by a nonprofit, nonpublic school 38 or operated pursuant to a service contract with a school district for trans- 39 porting children to or from school or in connection with school approved 40 activities, the annual fee shall be twenty-four dollars ($24.00). 41 (3) For all motorcycles and all-terrain vehicles operated upon the public 42 highways the annual fee shall be nine dollars ($9.00). For operation of an 43 all-terrain vehicle or motorcycle off the public highways, the fee specified 2 1 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro- 2 vided in section 49-426(2) and (3), Idaho Code, apply to all-terrain vehicles 3 and motorcycles used for the purposes described in subsections (2) and (3) of 4 section 49-426, Idaho Code. 5 (4) For all motor homes the fee shall be as specified in subsection (1) 6 of this section and shall be in addition to the fees provided for in section 7 49-445, Idaho Code. 8 (5) Registration fees shall not be subject to refund. 9 (6) A financial institution or repossession service contracted to a 10 financial institution repossessing vehicles under the terms of a security 11 agreement shall move the vehicle from the place of repossession to the finan- 12 cial institution's place of business on a repossession plate. The repossession 13 plate shall also be used for demonstrating the vehicle to a prospective pur- 14 chaser for a period not to exceed ninety-six (96) hours. The registration fees 15 for repossession plates shall be as required in subsection (1) of this section 16 for a vehicle one (1) and two (2) years old. All other fees required under 17 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee. 18 The repossession plate shall be issued on an annual basis by the department. 19 (7) In addition to the annual registration fee in this section, there 20 shall be an initial program fee of twenty-five dollars ($25.00) and an annual 21 program fee of fifteen dollars ($15.00) for all special license plate programs 22 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408, 23 49-409, 49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur- 24 suant to sections 49-406 and 49-406A, Idaho Code, there shall be an initial 25 program fee of twenty-five dollars ($25.00) but there shall be no annual 26 renewal fee. For special plates issued pursuant to sections 49-417, 49-417A, 27 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-419, 49-419A, 49-420, 49-420A 28 and 49-420B, Idaho Code, there shall be an initial program fee of thirty-five 29 dollars ($35.00) and an annual program fee of twenty-five dollars ($25.00). 30 The fees contained in this subsection shall be applicable to all new special 31 plate programs. The initial program fee and the annual program fee shall be 32 deposited in the state highway account and shall be used to fund the cost of 33 administration of special license plate programs, unless otherwise specified 34 by law. 35 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is 36 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 37 ignated as Section 49-420A, Idaho Code, and to read as follows: 38 49-420A. IDAHO STATE CAPITOL COMMISSION PLATES. (1) On and after January 39 1, 2002, and through December 31, 2006, any person who is the owner of a vehi- 40 cle registered under the provisions of section 49-402, Idaho Code, or regis- 41 tered under any other section of law for which the purchase of special plates 42 is allowed, may apply for and, upon department approval, receive special Idaho 43 state capitol commission plates in lieu of regular license plates. On and 44 after January 1, 2007, the department shall not issue new plates pursuant to 45 this section nor shall it renew any plates previously issued under this sec- 46 tion, the provisions of section 49-443, Idaho Code, relating to time period 47 for validity of plates, notwithstanding. 48 (2) The provisions of this section shall not apply to any vehicle with a 49 registered maximum gross weight over twenty-six thousand (26,000) pounds. 50 Availability of Idaho state capitol commission plates for other vehicles shall 51 be subject to the rules, policies and procedures of the department. 52 (3) In addition to the regular registration fee required in chapter 4, 53 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol- 3 1 lars ($35.00) for the initial issuance of plates, and twenty-five dollars 2 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the 3 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in 4 the state highway account and shall be used to fund the cost of administration 5 of this special license plate program. Twenty-five dollars ($25.00) of each 6 initial fee and fifteen dollars ($15.00) of each renewal fee shall be depos- 7 ited by the state treasurer in the Idaho capitol endowment income fund estab- 8 lished in section 67-1611, Idaho Code, and shall be used exclusively for the 9 purposes of chapter 16, title 67, Idaho Code. 10 (4) Whenever title or interest in a vehicle registered under the provi- 11 sions of this section is transferred or assigned, the owner may transfer the 12 special plates to another vehicle upon payment of the required transfer fees. 13 The owner may only display the plates on another vehicle upon receipt of the 14 new registration from the department. 15 (5) Notwithstanding the provisions of section 49-402C, Idaho Code, the 16 Idaho state capitol commission license plate shall be of a color and design 17 acceptable to the Idaho state capitol commission, except that the word "Idaho" 18 shall appear on each plate and the county designator shall be omitted to pro- 19 vide for distinguishing designs and slogans. The design shall be approved by 20 the department, utilizing a numbering system as determined by the department. 21 Initial costs of the plate program, including costs of plate design, shall be 22 paid by the Idaho state capitol commission. 23 (6) Sample Idaho state capitol commission license plates may be purchased 24 for a fee of thirty dollars ($30.00), ten dollars ($10.00) of which shall be 25 deposited in the state highway account and twenty dollars ($20.00) of which 26 shall be deposited in the Idaho capitol endowment income fund. No additional 27 fee shall be charged for personalizing sample plates. 28 SECTION 3. This act shall be in full force and effect on and after Janu- 29 ary 1, 2002.
STATEMENT OF PURPOSE RS 10951 The Idaho State Capitol Building was constructed from 1905-1920. There never has been a comprehensive restoration of the Capitol. The Idaho State Capitol Commission is attempting to complete the restoration of Idaho s Capitol Building in time for its centennial celebration on July 3, 2005. In addition to other private fund-raising efforts being pursued by the commission, this legislation would allow the creation of a special Capitol restoration license plate to help pay for Capitol renovations. A Capitol license plate would allow Idaho citizens to contribute funding to the restoration of their Capitol, and would help spread awareness throughout the state of the Capitol restoration effort. FISCAL NOTE This bill has no fiscal impact on the general fund. Based on previous experience with the Timber and Wildlife special plate programs, it is estimated that a specially designed Capitol license plate would raise between $100,000 and $150,000 per year for Capitol restoration efforts.
