  1                                        AN ACT
  2    RELATING TO COMPENSATION OF HIGHWAY DISTRICT COMMISSIONERS;  AMENDING  SECTION
  3        40-1314,  IDAHO CODE, TO INCREASE THE MAXIMUM ALLOWABLE SALARY FOR COMMIS-
  4        SIONERS OF DISTRICTS ORGANIZED UNDER CHAPTER 17, TITLE 40, IDAHO CODE,  TO
  5        NINE  HUNDRED  DOLLARS PER MONTH AND TO ONE THOUSAND DOLLARS PER MONTH FOR
  6        THE PRESIDENT OR CHAIRMAN OF THE DISTRICT, TO INCREASE THE SALARY OF  COM-
  7        MISSIONERS  OF  ALL OTHER DISTRICTS TO SEVENTY-FIVE DOLLARS PER DAY NOT TO
  8        EXCEED A MAXIMUM OF SIX THOUSAND DOLLARS PER YEAR, AND TO PROVIDE  A  CODE
  9        REFERENCE; AND AMENDING SECTION 40-1404A, IDAHO CODE, TO INCREASE THE MAX-
 10        IMUM  ALLOWABLE SALARY OF COMMISSIONERS IN COUNTYWIDE HIGHWAY DISTRICTS IN
 11        COUNTIES WITH A POPULATION OF MORE THAN TWO HUNDRED THOUSAND TO ONE  THOU-
 12        SAND  TWO  HUNDRED DOLLARS PER MONTH AND TO ONE THOUSAND FOUR HUNDRED DOL-
 13        LARS PER MONTH FOR THE PRESIDENT OF THE DISTRICT.
                                                                        
 14    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 15        SECTION 1.  That Section 40-1314, Idaho Code, be, and the same  is  hereby
 16    amended to read as follows:
                                                                        
 17        40-1314.  COMPENSATION OF HIGHWAY DISTRICT COMMISSIONERS, OFFICERS, AGENTS
 18    AND  EMPLOYEES.  (1)  The highway district commissioners may be compensated as
 19    follows:
 20        (a)  Commissioners of a countywide highway district  organized  under  the
 21        provisions  of  chapter  14, title 40, Idaho Code, as provided in sections
 22        40-1404 and 40-1404A, Idaho Code.
 23        (b)  Commissioners of a countywide highway district  organized  under  the
 24        provisions  of  chapter  17,  title 40, Idaho Code, a salary not to exceed
 25        five nine hundred dollars ($5900) per calendar month for each member  with
 26        the  exception  of  the president or chairman of the highway commissioners
 27        who may receive six hundred one thousand dollars  ($61,000)  per  calendar
 28        month,  provided  the  population  of  the  county  exceeds fifty thousand
 29        (50,000).
 30        (c)  Commissioners of all other highway districts, a salary of fifty  sev-
 31        enty-five  dollars  ($750.00)  for  each  day in the actual performance of
 32        duties, but the total amount to be  received  as  compensation  shall  not
 33        exceed the sum of four six thousand dollars ($46,000) per year.
 34        (2)  Actual  expenses shall be paid in addition to their compensation. The
 35    payment for expenses shall be paid from the funds of the highway district upon
 36    the presentation of itemized vouchers, signed by the commissioners  and  under
 37    oath made to the secretary of the district.
 38        (3)  When  a  commissioner is an officer and/or agent of the district, the
 39    two (2) remaining commissioners may fix the compensation to be  paid  him  for
 40    his  services  as an officer and/or agent. A commissioner acting as an officer
 41    and/or agent of the district shall be entitled to  his  necessary  and  actual
 42    expenses  in addition to his salary, but shall not be entitled to draw compen-
 43    sation as a commissioner when placed upon a salary. The board  shall  fix  the

  1    compensation  to be paid to the other officers and agents and employees of the
  2    highway district, to be paid out of the treasury of the highway district.
  3        (4)  Commissioners are considered employees of the district. The  district
  4    shall  be  liable  and responsible for the actions of the commissioners, offi-
  5    cers, agents and/or employees of the district when  the  commissioners,  offi-
  6    cers,  agents  and/or  employees  are performing their duties on behalf of the
  7    district.
                                                                        
  8        SECTION 2.  That Section 40-1404A, Idaho Code, be, and the same is  hereby
  9    amended to read as follows:
                                                                        
 10        40-1404A.  ELECTIONS,  TERMS  AND  SALARIES  OF  COMMISSIONERS  IN CERTAIN
 11    COUNTYWIDE HIGHWAY DISTRICTS. In countywide highway  districts  located  in  a
 12    county  with  a population of more than two hundred thousand (200,000) persons
 13    in which the voters have chosen to establish a countywide highway district  at
 14    a  previous  election, the county shall be divided by the county commissioners
 15    immediately upon the effective date of this act  into  five  (5)  subdistricts
 16    which  shall  be  as  nearly  equal in population as practicable. No precincts
 17    shall be divided. A highway district commissioner shall be a resident  of  the
 18    subdistrict  which  he  represents. Voters in each subdistrict shall vote only
 19    for one (1) candidate seeking to represent that  subdistrict.  County  commis-
 20    sioners,  mayors and city council members shall not be eligible to hold office
 21    as a countywide highway district commissioner. At the election held  in  1998,
 22    commissioners  representing subdistricts two and five shall be elected for two
 23    (2) year terms and commissioners  representing  subdistricts  three  and  four
 24    shall  be elected for four (4) year terms. Thereafter, all commissioners shall
 25    be elected for four (4) year terms. Any incumbent in office on  the  effective
 26    date  of  this  act may complete the term to which they were elected and shall
 27    represent the subdistrict in which they reside. Any incumbent in office on the
 28    effective date of this act whose term expires on January 1, 2000, shall retain
 29    that office until January 1, 2000, shall be assigned the subdistrict in  which
 30    they  reside  by the county commissioners, which subdistrict shall be numbered
 31    one as provided in this section and that commissioner need not stand for elec-
 32    tion in 1998.
 33        A qualified voter of the countywide highway district shall be eligible  to
 34    vote  for a countywide highway district commissioner residing in the elector's
 35    subdistrict, and the election shall be conducted as provided by Idaho statutes
 36    relating to holding  general elections at the county level.
 37        The highway commissioners shall take office on   January  1  of  the  year
 38    immediately  following  their  election,  and each may receive a salary not to
 39    exceed six one thousand two hundred dollars ($61,200) per calendar month  with
 40    the  exception of the president of the highway commissioners who may receive a
 41    salary not to exceed seven one thousand four  hundred  dollars  ($71,400)  per
 42    calendar month.

Statement of Purpose / Fiscal Impact

This legislation increases the daily salary provided for
highway district commissioners from $50.00 to $75.00 dollars per day,
and increases the salary expenditure cap from $4,000.00 to
$6,000.00 per annum. The salary of county-wide highway district
commissioners with a population of over 50,000 people would increase
from $500.00 per calendar month to an amount not to exceed $900.00, and
the president or chairman of the highway district would receive
$1000.00. The legislation also provides for a single county-wide 
highway district commissioners to receive $1200.00 per month, with 
the chairman receiving $1400.00 per month.

This legislation recognizes the additional responsibilities that
highway district commissioners are being required to undertake,
particularly in the multi-agency planning organizations. Highway 
district commissioners devote many hours outside of their occupations 
to the needs of the transportation community, often at their own 
expense. This legislation helps offset these additional 
responsibilities and costs.   

                          FISCAL IMPACT

No fiscal impact to the general account. Minimal impact to the
local highway district dedicated account. The estimated impact of this
legislation to the 64 highway district budgets would be less than 
$50,000.00 statewide.
