|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1081 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO THE STATE PERSONNEL SYSTEM; AMENDING CHAPTER 53, TITLE 67, IDAHO 3 CODE, BY THE ADDITION OF A NEW SECTION 67-5309D, IDAHO CODE, TO REQUIRE A 4 RULE GOVERNING THE EMPLOYMENT AND TRAINING OF INDIVIDUALS ENGAGED AS 5 INVESTIGATORS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 53, Title 67, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 67-5309D, Idaho Code, and to read as follows: 10 67-5309D. RULE GOVERNING INVESTIGATOR CERTIFICATION AND TRAINING. The 11 administrator shall adopt a rule governing the employment of individuals as 12 investigators by the several departments of state government. The rule shall 13 require that any person who conducts criminal investigations as a regular part 14 of his duties shall attend and successfully complete the police officer stan- 15 dards and training academy course for investigators or its equivalent. Atten- 16 dance shall be required as soon as practical after employment, and the cost of 17 training and certification shall be paid by the agency employing the investi- 18 gator.
STATEMENT OF PURPOSE RS10848 This legislation directs the Administrator of Human Resources to adopt a rule governing the employment of individuals of Departments of Idaho State Government. It would require that persons who conduct criminal investigations, as a regular part of their duties, for a department shall successfully complete the police officer's standards and training course for investigators or its equivalent. Attendance should be required as soon as possible after employment The agencies include, but are not limited to: The Bureau of Occupational License, Department of Finance, Department of Health and Welfare, Department of Insurance, State Tax Commission and the Department of Transportation. Investigators from these agencies conduct criminal investigations, some more that others, but all have filed criminal cases with the state and local prosecutors. While conducting these investigations, they are dealing with the same types of issues that Police and Sheriff Detectives with Law Enforcement agencies are dealing with. Those issues include: constitutional issues of suspects rights, search and seizure, Miranda rights, search warrants and probable cause, dealing with the fourth and fifth amendments to the constitution. Currently there is no mandated level of training or certification that these state investigators are required to obtain or maintain before they are sent out to investigate and prosecute citizens of the State of Idaho. FISCAL IMPACT The training would be paid for out of each departments budget for employee education. The academy is based in Meridian and most of the people affected would be based in Boise. Investigators from other parts of the State would have to have their expenses paid to Meridian. The cost for the course is $200.00 per person.
