|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1093 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO AUTOMOBILE INSURANCE; AMENDING SECTION 41-2515, IDAHO CODE, TO 3 REDUCE THE AGE FOR WHICH AN INSURANCE DISCOUNT SHALL BE PROVIDED, TO FIX 4 THE DISCOUNT RATE AT TEN PERCENT, TO ELIMINATE A PROVISION PERMITTING PRI- 5 VATE COMPARABLE PREMIUM REDUCTIONS AND TO CORRECT A CODIFIER'S ERROR. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 41-2515, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 41-2515. DISCOUNT FOR CERTAIN AGE GROUPS. (1) Any insurer offering for 10 sale an automobile insurance policy, as policy is defined in subsection (a) of 11 section 41-2506, Idaho Code, in which there is insured a principal operator 12 who issixtyfifty-five (655) years of age or older, shall provide for an13appropriateten percent (10%) reduction in premium charges for liability, med- 14 ical payments and collision coverages if the principal operator 15sixtyfifty-five (655) years of age or older has successfully completed a motor 16 vehicle accident prevention course which meets criteria established by the 17 motor vehicle bureau of the transportation department. However, there shall be 18 no reduction in premiums for completion of a self-instructed course or a 19 course which does not provide for actual classroom or field driving instruc- 20 tion.Any discount used by an insurer shall be presumed appropriate unless21credible evidence data demonstrates otherwise.22 (2) Upon successful completion of an approved motor vehicle accident pre- 23 vention course, each participant shall be issued, by the course's sponsoring 24 entity, a certificate of completion which shall be the basis of the qualifica- 25 tion for the discount on the automobile insurance. 26 (3) The premium reduction required in this section shall be effective for 27 an insured for a three (3) year period after successful completion of the 28 approved course, except that the insurer may require, as a condition of pro- 29 viding and maintaining the discount, that the insured for a three (3) year 30 period after course completion, not be involved in an accident for which the 31 insured is at fault or be found guilty of a moving traffic violation. 32 (4) The provisions of this section shall not apply in the event the 33 approved course is specified by a court or other governmental entity resulting 34 from a moving traffic violation. 35 (5) Each participant shall take an approved course every three (3) years 36 to continue to be eligible for the reduction in premiums. 37 (6) Nothing in the provisions of this section shall be deemed to prohibit 38 an insurer from canceling or not renewing an automobile insurance policy for 39 grounds enumerated in section 41-2507, Idaho Code, or in chapter 25, title 41, 40 Idaho Code. 41(7) The provisions of this section shall not apply in the event that such42an insurer offers a premium reduction which is substantially comparable to the43premium reduction required in this section and in no event shall such insurer2 1be required to provide both comparable premium reductions on a cumulative2basis.
STATEMENT OF PURPOSE R. S. 10973 The purpose of this legislation is to amend Section 41-25 15, Idaho Code, to reduce the age for which an insurance discount shall be provided and to fix the discount rate at 10 per cent.
