|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1126 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO STATE GOVERNMENT AND STATE AFFAIRS; AMENDING CHAPTER 57, TITLE 67, 3 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-5711D, IDAHO CODE, TO 4 REQUIRE THE EMPLOYMENT OF CERTAIN IDAHO APPRENTICES FOR PARTICULAR STATE 5 PUBLIC WORKS PROJECTS AND TO AUTHORIZE THE DIRECTOR OF THE DEPARTMENT OF 6 ADMINISTRATION TO MODIFY OR WAIVE THE REQUIREMENT UNDER CERTAIN CIRCUM- 7 STANCES; TO PROVIDE AN EFFECTIVE DATE AND TO PROVIDE APPLICATION. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 57, Title 67, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 67-5711D, Idaho Code, and to read as follows: 12 67-5711D. EMPLOYMENT OF APPRENTICES. (1) To the extent permitted by fed- 13 eral laws and regulations or reciprocity agreements with other states, when- 14 ever the state of Idaho or any department, division, bureau or agency thereof, 15 shall let for bid any contract for construction, repair or maintenance of any 16 state public work which has an estimated cost of two million dollars 17 ($2,000,000) or more, the director of the department of administration shall 18 specify that Idaho resident apprentices placed on the registry maintained by 19 the bureau of apprenticeship and training of the United States department of 20 labor or other reciprocal registries shall be employed in sufficient number to 21 constitute at least fifteen percent (15%) of the total labor hours performed 22 on the work. 23 (2) The director of the department of administration in an emergency, for 24 a demonstrated lack of availability of apprentices in a specific geographic 25 area, or upon other criteria deemed appropriate, shall have the authority to 26 modify or waive this provision for a specified work or for a specified occupa- 27 tion or skill on a work. 28 SECTION 2. This act shall be in full force and effect on and after July 29 1, 2001, and shall apply only to those public works let for bid on and after 30 the effective date.
STATEMENT OF PURPOSE RS 11010 The purpose of this bill is to increase opportunities for apprenticeships in construction for Idaho residents and increase the number of skilled laborers. It requires the director of the Idaho department of administration to specify that 15% of the total labor hours on a public works contract of $2 million or more be set aside for apprenticeships. The director may waive or modify this requirement when deemed appropriate. FISCAL IMPACT There will be very minimal administrative costs to the department of administration.
