That Section 21-132, Idaho Code, be, and the same is hereby 18 amended to read as follows: 19 21-132. DECLARATION OF PURPOSE. It is hereby found and declared that 20 there exists in the state of Idaho a need to improve and expand air service 21 capabilities to meet the increased demands of air transportation. In view of 22 the rapid growth of this mode of passenger transportation, faster and heavier 23 aircraft, the anticipated use of this system by industry for moving high value 24 goods and merchandise in a minimum of time, to save handling and warehousing, 25 planning to meet future needs is imperative. Such planning must accommodate 26 intrastate and interstate service for passengers and freight into the national 27 system, with implementation as rapidly as possible. The efforts of both the 28 public and private sectors must be combined to match the aviation program 29 planned by congress forimplementation in the early 1970'sthe new millennium. 30 SECTION 2. That Section 21-134, Idaho Code, be, and the same is hereby 31 amended to read as follows: 32 21-134. IDAHO AERONAUTICS ADVISORY BOARD CREATED -- DUTIES -- COMPENSA- 33 TION. There is hereby created and established the Idaho aeronautics advisory 34 board. The board shall consult with and advise the Idaho transportation 35 department on matters concerning aeronautics. Members shall be compensated as 36 provided by section 59-509(gh), Idaho Code. 37 SECTION 3. That Section 21-135, Idaho Code, be, and the same is hereby 38 amended to read as follows: 39 21-135. COMPOSITION OF ADVISORY BOARD -- NUMBER -- APPOINTMENT -- QUALI- 2 1 FICATIONS. The advisory board shall be composed ofthreefive (35) members to 2 be appointed by the governor. All members shall be knowledgeable and have 3 experience in aviation; provided however, one (1) member shall have particular 4 knowledge of commercial aviation; one (1) member shall have knowledge of gen- 5 eral aviation; one (1) member shall have particular knowledge of back-country 6 aviation; and one (1) member shall have particular knowledge of air freight 7 transportation. Not more thantwothree (23) members thereof shall at any time 8 belong to the same political party. Provided, however, two (2) members of the 9 advisory board shall beratedlicensed pilots. Members shall be successful 10 public spirited citizens of good character, well informed and interested in 11 the construction and maintenance of aeronautical facilities. Selection and 12 appointment shall be made solely with regard to the best interests of the var- 13 ious functions of the advisory board. Each member at the time of his appoint- 14 ment shall be a citizen and resident taxpayer of the state of Idaho, and of 15 the members appointed to represent director districts, such member shall be a 16 resident of the district from which he is appointed for at least three (3) 17 years, and during his tenure of office. Nno member shall hold or occupy any 18 elective or other appointive office, federal, state, county or municipal., or19any office in any political party.20 SECTION 4. That Section 21-136, Idaho Code, be, and the same is hereby 21 amended to read as follows: 22 21-136. APPOINTMENT OF MEMBERS -- TERM -- VACANCIES. For the purposes of 23 selection of members of the advisory board of aeronautics, one (1) member 24 shall be appointed to represent director districts no. 1 and 2, one (1) member 25 to represent director districts no. 3 and 4,andone (1) member to represent 26 director districts no. 5 and 6, as provided in section 40-303, Idaho Code, and 27 two (2) members shall be appointed from the state at-large. 28Each of the enumerated districts shall, at all times, be represented by29one (1) board member, appointed from one (1) of the two (2) director districts30represented.The governor shall appoint, subject to confirmation by the sen- 31 ate, the board members for terms ofthreefive (35) years, and no member shall 32 be appointed to more than two (2) consecutive five (5) year terms. The initial 33 terms of the at-large members may be less than five (5) years, and shall be 34 staggered so that not more than (1) term of any member of the board shall 35 expire in any one (1) year. The term of each member shall begin immediately 36 upon his appointment and qualification. Each member shall hold office after 37 the expiration of his term until his successor has been appointed. Not less 38 than fifteen (15) days before the expiration of the term of appointment of 39 each member, the governor shall appoint a successor and submit the appointment 40 to the senate for confirmation. Should any member of the board resign, die, 41 remove from the district from which he was appointed, or otherwise be removed 42 from office, a vacancy shall exist, and during the recess of the legislature, 43 the governor shall within thirty (30) days appoint a successor with like qual- 44 ifications, to serve for the remainder of the retiring member's unexpired 45 term. If a vacancy occurs within forty-five (45) days after the convening of 46 the legislature and while it is still in session, the governor shall make and 47 submit to the senate for its approval a nomination to fill the vacancy.

STATEMENT OF PURPOSE RS11209C1 The purpose of this legislation is to expand the Aeronautics Advisory Board from three members to five members. Terms would be expanded from three years to five years. Regional representation stays the same with three of the five members representing Districts 1 and 2, 3 and 4, 5 and 6 respectively. Of the five board members, one member would represent the general public and be knowledgeable and have experience in aviation; one member would be knowledgeable and have experience in commercial aviation; one member would be knowledgeable and have experience in general aviation; one member would be knowledgeable and have experience in back-country flying; and one member would be knowledgeable and have experience in air freight transportation. The salary of each member would be raised from $35 to $50 per day. FISCAL IMPACT There is an estimated $8-10,000 impact to the State Aeronautics Fund for the two additional members' attendance at quarterly meetings. Contact: Sen.
