Attorney General for fiscal year 2002; provides for the transfer of the
balance from the State Legal Services Fund; specifies legislative intent

  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE ATTORNEY GENERAL FOR FISCAL YEAR  2002;  PROVIDING
  3        FOR  THE  TRANSFER  OF  CERTAIN  FUNDS; EXPRESSING LEGISLATIVE INTENT WITH
  4        RESPECT TO CERTAIN EXPENDITURES; LIMITING THE NUMBER OF  AUTHORIZED  FULL-
  5        TIME EQUIVALENT POSITIONS; AND REAPPROPRIATING FUNDS FOR THE SPECIAL LITI-
  6        GATION PROGRAM.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  There is hereby appropriated to the Attorney General the fol-
  9    lowing amounts to be expended for the designated  programs  according  to  the
 10    designated  expense classes from the listed funds for the period July 1, 2001,
 11    through June 30, 2002:

 27        SECTION 2.  Upon the closing of fiscal year  2001,  the  State  Controller
 28    shall,  at  the  request  of  the Office of the Attorney General, transfer any
 29    remaining cash balance to the General Fund from the State Legal Services Fund.
                                                                        
 30        SECTION 3.  It is legislative intent that an amount, not to exceed $1,000,
 31    of the amount appropriated in Section 1 of this act, may be used at  the  dis-
 32    cretion of the Attorney General to assist in defraying expenses relating to or
 33    resulting  from  the discharge of the Attorney General's official duties. Such
 34    moneys shall be accounted for according to the provisions of Chapter 36, Title
 35    67, Idaho Code, and Section 67-3516, Idaho Code.
                                                                        
 36        SECTION 4.  In accordance with Section 67-3519, Idaho Code,  the  Attorney
 37    General  is  authorized  no  more  than  one hundred eighty-three and fifteen-
 38    hundredths (183.15) full-time equivalent positions at  any  point  during  the
 39    period July 1, 2001, through June 30, 2002, for the programs specified in Sec-
 40    tion  1 of this act, unless specifically authorized by the Governor. The Joint

  1    Finance-Appropriations Committee will be notified promptly  of  any  increased
  2    positions so authorized.
                                                                        
  3        SECTION 5.  There is hereby reappropriated to the Attorney General for the
  4    Special Litigation Program any unexpended and unencumbered balance of the Gen-
  5    eral  Fund  as appropriated for the Special Litigation Program for fiscal year
  6    2001, to be used for the period July 1, 2001, through June 30, 2002.

Replacement Items: Capital outlay of $72,700 for computers and printers; $23,300 for servers and uninterruptible power supply; $50,000 for two vehicles; and $12,000 for office furniture. Operating expenditures of $96,900 for computer software upgrades, training, and network cabling.

Annualizations: Elected official pay increase of $1,900; and $23,200 for the office secretary authorized in the supplemental “Implement Telephone Solicitation Act.”

Fund Shifts: Implement budget and billing reform for legal services fees to state agencies. The Office of the Attorney General will be funded through the General Fund except for consumer protection education efforts and the federal grant to fight white collar crime in keeping with HB 218, enacted during the 2001 legislative session. All legal service fees will be deposited to the General Fund so that this reform is revenue neutral.

1) Natural Resource Litigation is one-time funding to support primarily the Snake River Basin Adjudication. Carryover is also authorized for the FY 2001 Original Appropriation for the Special Litigation Program.

2) Legal Secretary for Criminal Appeals to support workload increase in the number of criminal appeals.

3) Civil Litigation Staff to support the enforcement of antitrust issues and the Telephone Solicitation Act.

5) Paralegal for the Dept. of Lands is for a legal support position that was removed from the Dept. of Lands for FY 2002 and placed into the Office of the Attorney General.
