|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1264 BY FINANCE COMMITTEE 1 AN ACT 2 APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF AGRICULTURE FOR FISCAL 3 YEAR 2002; AND AUTHORIZING ADDITIONAL FULL-TIME EQUIVALENT POSITIONS. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. In addition to the appropriation made in Section 1 of Senate 6 Bill No. 1240 as enacted by the First Regular Session of the Fifty-sixth Idaho 7 Legislature, there is hereby appropriated to the Department of Agriculture the 8 following amounts to be expended for the designated program according to the 9 designated expense classes from the listed fund for the period July 1, 2001, 10 through June 30, 2002: 11 I. ANIMAL INDUSTRIES: 12 FOR: 13 Personnel Costs $159,000 14 Operating Expenditures 25,000 15 Capital Outlay 66,000 16 TOTAL $250,000 17 FROM: 18 General Fund $250,000 19 SECTION 2. In addition to the authorization provided to the Department of 20 Agriculture in Section 2 of Senate Bill No. 1240 as enacted by the First Regu- 21 lar Session of the Fifty-sixth Idaho Legislature, there is hereby authorized 22 three (3) additional full-time equivalent positions for the period July 1, 23 2001, through June 30, 2002.

This trailer bill provides $250,000 in funding for additional staffing to the Idaho State Department of Agriculture to handle the workload caused by passage of H262aaS, the odor management legislation. H262aaS designated the Department of Agriculture as the lead agency responding to odor complaints lodged against agricultural operations. Furthermore, the department will regulate and approve the design and construction of liquid waste management systems. If the department determines that the agricultural operation is generating odors in excess of levels associated with accepted practices, then the operator must develop and submit an odor management plan. The department must approve the plan and periodically review compliance with the plan.

This appropriation provides $250,000 from the State General Fund to the Idaho State Department of Agriculture for fiscal year 2002 in addition to the regular appropriation. The appropriation funds $159,000 for three additional positions; $25,000 for travel, training, and administrative costs; and $66,000 for three trucks and three computers. The positions include one engineer and two technicians. One position will be stationed in Pocatello, one in Twin Falls, and one in Boise.
