  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND DIRECTING THE DEPARTMENT OF HEALTH AND
  3        WELFARE TO APPLY FOR A WAIVER ALLOWING  SURVEYS  OF  CERTAIN  HEALTH  CARE
  4        FACILITIES  BY  INDEPENDENT ACCREDITING ORGANIZATIONS TO BE DEEMED TO MEET
  5        STATE INSPECTION REQUIREMENTS.
                                                                        
  6    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  7        WHEREAS, many skilled nursing facilities and intermediate care  facilities
  8    are  subject to inspections by the Joint Commission on Accreditation of Health
  9    Care Organizations (JCAHO) or the Commission of Accreditation  of  Rehabilita-
 10    tion Facilities (CARF) and additional inspections are costly and unnecessarily
 11    duplicative; and
 12        WHEREAS,  it is in the interests of the facilities, the state of Idaho and
 13    the welfare of those who receive care that  unnecessary  waste  be  eliminated
 14    whenever possible.
 15        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 16    of  the Fifty-sixth Idaho Legislature, the Senate and the House of Representa-
 17    tives concurring therein,  that  the  Department  of  Health  and  Welfare  is
 18    directed  to research and apply for deemed status with the Health Care Financ-
 19    ing Administration (HCFA) to allow other accrediting bodies such as  JCAHO  or
 20    CARF  to  survey  and monitor skilled nursing facilities and intermediate care
 21    facilities. The Department of Health and Welfare should work with  representa-
 22    tives of the facilities to develop the specific terms of this proposal and its
 23    implementation  including:  (1)  how  the  deemed status of accrediting survey
 24    would be made optional to facilities; (2) how to proceed if a facility did not
 25    pass an independent inspection; (3) how the Department would handle  complaint
 26    investigations;  (4)  how  the state or HCFA can help pay the cost of the sur-
 27    veys.
 28        BE IT FURTHER RESOLVED that if it is possible for the Department of Health
 29    and Welfare to implement such a waiver without amendment to  applicable  state
 30    law,  they  shall  do  so. If amendment to statute is required, the Department
 31    shall submit such proposed changes  to  the  Second  Regular  Session  of  the
 32    Fifty-sixth Idaho Legislature.

Statement of Purpose / Fiscal Impact


                    STATEMENT OF PURPOSE
                          RS 11043
                              
   This resolution would direct the Idaho Department of Health and Welfare to apply to the
   United States Department of Health Care Financing Administration (HCFA) for
   "deemed status" for certain nursing facilities in Idaho. This "deemed status" would allow
   certain nursing facilities, at their discretion, to undergo independent accrediting surveys,
   and if the facilities achieved accreditation by these independent organizations, the
   Department of Health and Welfare would not be required to perform routine annual
   licensure and certification surveys.
   
   
                       FISCAL IMPACT
                              
   This application project should in no way require more than 160 hours to complete. The
   average wage of employees in the Bureau of Facility Standards is approximately $19 per
   hour. Therefore, this assignment should have a one-time expense of approximately
   $3040. The Idaho Health Care Association is happy to assist in any way that they can. If
   successful in their request to HCFA, the Department of Health and Welfare could save
   tens of thousands of dollars annually by not being required to survey exceptional,
