SPEAKER Requested by: Bureau of Occupational Licenses 1 AN ACT 2 RELATING TO THE BOARD OF PODIATRY; AMENDING SECTION 54-608, IDAHO CODE, TO 3 PROVIDE FOR THE SUSPENSION, DENIAL, REFUSAL OR REVOCATION OF A LICENSE DUE 4 TO A PERSON'S INABILITY TO PRACTICE PODIATRY BY REASON OF A PHYSICAL OR 5 MENTAL DISABILITY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 54-608, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 54-608. GROUNDS FOR SUSPENSION, DENIAL, REFUSAL TO RENEW OR REVOCATION OF 10 LICENSE. No license may be issued, and a license previously issued may be sus- 11 pended or revoked, if the person applying, or the person licensed is: 12 1. Found guilty by a court of competent jurisdiction of a felony or any 13 offense involving moral turpitude; 14 2. Found by the board to be a repeated and excessive abuser of any drug, 15 including alcohol, or any controlled substance; 16 3. Found by the board to be in violation of any provision of this act or 17 the rules promulgated pursuant thereto; 18 4. Found by the board to have used fraud or deception in the procuring of 19 any license; 20 5. Found by the board to have had any action, including denial of a 21 license or the voluntary surrender of or voluntary limitation on a license, 22 taken against the licensee by any peer review body, any health care institu- 23 tion, any professional medical society or association or any court, law 24 enforcement or governmental agency; or 25 6. Found by the board to have been unethical, unprofessional or dishonor- 26 able in the practice of healing the sick. 27 7. Found by the board to be unable to practice podiatry with reasonable 28 skill and safety by reason of a physical or mental disability.
STATEMENT OF PURPOSE RS 10483 The purpose of this legislation is to further protect the health safety and welfare of the public. Currently, the law does not provide for protection of the public in regard to licensed Podiatrists with physical or mental disabilities that hinder their practice. FISCAL IMPACT There is no fiscal impact to the general fund or dedicated funds. CONTACT Name: Thomas E.
