SPEAKER Requested by: Bureau of Occupational Licenses 1 AN ACT 2 RELATING TO THE REAL ESTATE APPRAISER BOARD; AMENDING SECTION 54-4106, IDAHO 3 CODE, TO PROVIDE THAT THE IDAHO REAL ESTATE APPRAISER BOARD MAY ADOPT 4 RULES RELATING TO THE REGISTRATION AND LIMITATIONS OF REAL ESTATE 5 APPRAISER TRAINEES AND TO MAKE TECHNICAL CORRECTIONS. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 54-4106, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 54-4106. REAL ESTATE APPRAISERS -- REAL ESTATE APPRAISER BOARD -- POWERS 10 AND DUTIES -- COMPENSATION. (1) There is hereby created in the department of 11 self-governing agencies, a real estate appraiser board, hereinafter referred 12 to as the "board," which shall administer the provisions of this chapter. The 13 board shall consist of five (5) members to be appointed by the governor as 14 follows: 15 (a) One (1) from the northern district consisting of the counties of 16 Idaho, Lewis, Nez Perce, Clearwater, Latah, Benewah, Boundary, Shoshone, 17 Kootenai and Bonner; one (1) from the southeastern district consisting of 18 the counties of Lemhi, Butte, Clark, Fremont, Jefferson, Madison, Teton, 19 Bonneville, Bingham, Caribou, Bear Lake, Franklin, Oneida, Power and Ban- 20 nock; one (1) from the southwestern district consisting of the counties of 21 Owyhee, Elmore, Ada, Canyon, Boise, Gem, Payette, Washington, Adams and 22 Valley; one (1) from the south central district consisting of the counties 23 of Blaine, Camas, Cassia, Custer, Gooding, Jerome, Lincoln, Minidoka and 24 Twin Falls; and one (1) from the state at large; 25 (b) On July 1, 1990, the governor shall appoint the members of the board, 26 each of whom shall be a real estate appraiser with not less than five (5) 27 years' experience in the real estate appraisal business in Idaho. As of 28 July 1, 1999, the board appointment from the state at large is extended 29 for a period of two (2) years and the board appointment from the south 30 central district is extended for a period of one (1) year. Each regular 31 appointment thereafter, other than an appointment to fill an unexpired 32 term, shall be for a term of four (4) years and each board member shall 33 hold office until a successor is appointed and qualified. Upon the death, 34 resignation or removal of any member of the board, the governor shall 35 appoint a state licensed or state certified real estate appraiser to fill 36 the unexpired term. Appointments to fill any vacancy other than that 37 resulting from the expiration of a term shall be made for the unexpired 38 term. After July 1, 1991, new board members shall be required to be state 39 licensed or certified real estate appraisers with not less than five (5) 40 years' experience in the real estate appraisal business in Idaho; 41 (c) Within fifteen (15) days after the appointment of the members of the 42 board, the board shall call a meeting and organize by the election of a 43 chairman. Thereafter, the chairman may call meetings of the board whenever 2 1 he deems it advisable but if he refuses to call a meeting upon written 2 demand of the other four (4) members of the board, then such members may 3 call such meeting. Reasonable notice shall be given in writing by mail of 4 such meeting. 5 (2) The board shall have, in addition to the powers conferred elsewhere 6 in this chapter, the following powers and duties: 7 (a) To authorize, by written agreement, the bureau of occupational 8 licenses to act as its agent in its interest; 9 (b) To adopt, pursuant to the administrative procedure act, such rules as 10 the board, in its discretion, deems necessary for the administration and 11 enforcement of this chapter, and any such rules deemed necessary by the 12 board to keep the Idaho real estate appraisers act in compliance with fed- 13 eral law, rule, regulation or policy; 14 (c) To conduct investigations into violations of the provisions of this 15 chapter; 16 (d) To receive applications for and issue licenses or certificates to 17 real estate appraisers pursuant to this chapter; 18 (e) To hold meetings, hearings and examinations at such places and at 19 such times as it shall designate; 20 (f) To collect, deposit and disburse application and other fees, as 21 required by this chapter or federal law; 22 (g) To maintain a register of all state licensed or certified residential 23 and state certified general real estate appraisers;and24 (h) To censure a state licensed or certified appraiser or suspend or 25 revoke appraisal licenses or certificates as provided in this chapter, 26 subject to the provisions of the Idaho administrative procedure act, chap- 27 ter 52, title 67, Idaho Code; and 28 (i) To adopt rules governing the registration and limitations of real 29 estate appraiser trainees. 30 (3) Each member of the board of real estate appraisers shall be compen- 31 sated as provided in section 59-509(m), Idaho Code.
STATEMENT OF PURPOSE RS 10481 The amendment will provide for appraiser trainees, and give the board authority to develop by rule a registration program for trainees who are obtaining appraisal experience under licensed real estatea ppraisers.
