1 AN ACT
2 RELATING TO MINIMUM WAGE LAW; AMENDING SECTION 44-1504, IDAHO CODE, TO PROVIDE
3 APPLICATION OF MINIMUM WAGE LAW TO AGRICULTURAL LABOR BY REMOVING SUCH
4 LABOR FROM THE LIST OF EMPLOYEES EXCEPTED FROM MINIMUM WAGE LAW; AND PRO-
5 VIDING AN EFFECTIVE DATE.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 44-1504, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 44-1504. EMPLOYEES EXCEPTED FROM PROVISIONS OF ACT. The provisions of
10 this act shall not apply to any employee employed in a bona fide executive,
11 administrative, or professional capacity, to agricultural labor as that term
12 is defined in section 72-1304, Idaho Code, to anyone engaged in domestic ser-
13 vice, to any individual employed as an outside salesman, to seasonal employees
14 of a nonprofit camping program, or to any child under the age of sixteen (16)
15 years working part time or at odd jobs not exceeding a total of four (4) hours
16 per day with any one (1) employer.
17 SECTION 2. This act shall be in full force and effect on and after Janu-
18 ary 1, 2002.
STATEMENT OF PURPOSE
RS 10455
This legislation would extend coverage of Idaho s minimum wage law
to farm workers who are not covered by the federal minimum wage law,
about 40 per cent of farm workers. It would be effective Jan. 1 2002.
Workers employed by larger farm operations, those that had 500 or more
man days of labor in a previous calendar quarter, are already covered
by the federal minimum wage law, with a few exceptions. This
legislation would cover farm workers without exception, including
those who work by the piece. It would not eliminate piece rate work
or prevent workers from earning more than the minimum wage, but would
set a floor of $5.15 an hour for piece rate work. Most piece rate work
done for larger farm operations is presently covered by the federal
minimum wage law.
FISCAL IMPACT
This legislation would require the addition of two employees by the
wage and hour division of the Department of Labor. Annual cost would
be about $120,000.
