|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 135 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO LASER POINTERS; AMENDING CHAPTER 9, TITLE 18, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 18-923, IDAHO CODE, TO PROVIDE FOR CERTAIN 4 UNLAWFUL USES OF LASER POINTERS, TO PROVIDE FOR PUNISHMENT AND TO DEFINE 5 "LASER POINTER." 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 9, Title 18, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 18-923, Idaho Code, and to read as follows: 10 18-923. UNLAWFUL USE OF LASER POINTERS. (1) It is unlawful for any person 11 to knowingly direct light from a laser pointer at a peace officer, uniformed 12 security guard, uniformed school safety officer, uniformed traffic enforcement 13 officer, uniformed member of a paid or volunteer fire department, uniformed 14 emergency medical service worker, uniformed ambulance worker, or any other 15 city, state or federal peace officer, investigator or emergency service 16 worker, or the marked service vehicle of any such individual. 17 (2) It is unlawful for any person to knowingly direct light from a laser 18 pointer at any operator of a motor vehicle. 19 (3) A violation of this section is a misdemeanor punishable under section 20 18-902, Idaho Code. 21 (4) For purposes of this section, "laser pointer" means any device that 22 emits light amplified by the stimulated emission of radiation that is visible 23 to the human eye.
STATEMENT OF PURPOSE RS 10624C1 This legislation makes it unlawful for any person to knowingly direct light from a laser pointer at a peace officer, uniformed security guard, uniformed school safety officer, uniformed member of a paid or volunteer fire department, uniformed emergency medical service worker, uniformed ambulance worker, or any other city, state or federal peace officer. A violation under this legislation would be a misdemeanor punishable under section 18-902, Idaho Code.
