  1                                        AN ACT
  2    RELATING TO THE PUBLIC UTILITIES COMMISSION; AMENDING  SECTION  61-206,  IDAHO
  3        CODE,  TO PROVIDE THAT THE PIPELINE SAFETY SPECIALIST OF THE PUBLIC UTILI-
  4        TIES COMMISSION SHALL BE A NONCLASSIFIED EMPLOYEE; AND DECLARING AN  EMER-
  5        GENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  61-206, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        61-206.  EMPLOYEES. (1) The commission shall have power to employ,  during
 10    its  pleasure,  such officers, experts, engineers, statisticians, accountants,
 11    inspectors, clerks and employees as it may deem necessary  to  carry  out  the
 12    provisions  of  this act or to perform the duties and exercise the powers con-
 13    ferred by law upon the commission.
 14        (2)  In addition to the number  of  nonclassified  employees  provided  by
 15    other provisions of law, the commission shall have the authority to employ not
 16    more  than  three (3) nonclassified employees as regulatory policy strategists
 17    reporting directly to the commission and one (1) nonclassified pipeline safety
 18    specialist.
                                                                        
 19        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 20    declared to exist, this act shall be in full force and effect on and after its
 21    passage and approval.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE

The purpose of this legislation is to authorize the Idaho Public

Utilities Commission to employ a non-classified employee as the

inspector for the State Pipeline Safety Inspection Program.

This legislation shall be effective upon passage and approval.


                                 


                          FISCAL NOTE
                                
There should be no adverse impact on the general fund or other state
government funds. The U.S. Office of Pipeline Safety (USDOT) will
partially reimburse the Commission (by approximately 40-50%) for the
cost of the pipeline safety program. The remaining costs will come
from the Public Utilities Commission fund. This legislation will not
cause an increase in the maximum assessment level or an increase in
utility rates. The Commission intends to convert a currently unfilled
classified position to the non-classified Pipeline Safety Specialist
position.
