|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 226 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO THE BOARD OF ARCHITECTURAL EXAMINERS; AMENDING SECTION 54-312, 3 IDAHO CODE, TO INCREASE THE HONORARIUM FOR MEMBERS OF THE BOARD OF ARCHI- 4 TECTURAL EXAMINERS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 54-312, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 54-312. ARCHITECTS -- BOARD OF EXAMINERS -- POWERS AND DUTIES -- COMPEN- 9 SATION. 1. The board of architectural examiners is hereby created in the 10 department of self-governing agencies. The board of architectural examiners 11 shall consist of six (6) members, to be appointed by the governor, each of 12 whom shall be an architect, and shall have been a resident of and a lawfully 13 practicing architect within the state of Idaho for a period of at least five 14 (5) years next before his appointment. At all times the board shall have at 15 least one (1) member who is engaged primarily in professional architectural 16 education. 17 2. The board shall have, in addition to the powers conferred elsewhere in 18 this chapter, the following powers and duties: 19 a. To authorize, by written agreement, the bureau of occupational 20 licenses to act as its agent in its interest. 21 b. To adopt, pursuant to the administrative procedure act, such rules as 22 the board, in its discretion, deems necessary for the administration and 23 enforcement of this chapter. 24 c. To conduct investigations into violations of this chapter. 25 d. The board, or its duly appointed hearing officer, shall have the power 26 in any disciplinary proceeding under this chapter, to administer oaths, 27 take depositions of witnesses within or without the state in the manner 28 provided by law in civil cases, and may apply to any district court of 29 this state for a subpoena to require the attendance of such witnesses and 30 the production of such books, records, and papers as it deems necessary. 31 The fees and mileage of the witnesses shall be the same as that allowed in 32 the district courts in criminal cases, which fees and mileage shall be 33 paid in the same manner as other expenses of the board are paid. In any 34 case of disobedience to, or neglect of, any subpoena or subpoena duces te- 35 cum served upon any person, or the refusal of any witness to testify to 36 any matter regarding which he may lawfully be interrogated, it shall be 37 the duty of any district court in this state on application by the board 38 to compel compliance with the subpoena by proceedings for contempt, as in 39 the case of disobedience of the requirements of a subpoena issued from 40 such court or for refusal to testify therein. The licensed person accused 41 in such proceedings shall have the same right of subpoena. 42 3. Each member of the board of architectural examiners shall be compen- 43 sated as provided by section 59-509(mo), Idaho Code.
STATEMENT OF PURPOSE RS 10918 The Idaho State Board of Architecture Examiners was authorized compensation by the legislature in 1976. At that time 54-312(3), Idaho Code, authorized each board member to be compensated in the amount of $35.00 per day for those days spent conducting board business. That rate of compensation has not changed during the 25 years since the original creation of the board. The board spends an average of 12 days per year, away from their individual practices, conducting board business. The requested increase to $75.00 per day, while certainly not providing total compensation for a days work, would help defray a more reasonable portion of the loss in income incurred f or the benefit of Idaho s citizens. While those serving on the board do so in the spirit of service to the public, and do not expect to be fully compensated, such service should not put undue hardship on those who are asked to provide such service. FISCAL IMPACT The Board of Architecture has six members and meets an average of twelve times per year. If the compensation were to be raised from $35.00 to $75.00, the result would be an annual increase of $3,100 after adding the employers Social Security expense.
