|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 347 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC UTILITIES; AMENDING SECTION 61-610, IDAHO CODE, TO CLARIFY 3 THE AUTHORITY OF THE PUBLIC UTILITIES COMMISSION TO EXAMINE RECORDS AND TO 4 MAKE TECHNICAL CORRECTIONS. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 61-610, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 61-610. RIGHT TO INSPECT BOOKS AND EXAMINE EMPLOYEES. (1) The commission, 9 each commissioner and eachofficer andperson employed by the commission shall 10 have the right at any and all reasonable times to inspect the accounts, books, 11 papers and documents of any public utility., andThe commission shall also 12 have the right to inspect the records of a public utility's holding company, 13 parent, affiliate, or subsidiary that engages directly in any transaction with 14 the regulated utility which results in expenses being incurred, allocated or 15 otherwise attributed to regulated services of a public utility. 16 (2) Tthe commission, each commissioner andany officer of the commission17orany employee authorized to administer oaths shall have power to examine 18 under oath any officer, agent or employee of such public utility in relation 19 to the business and affairs of said public utility: provided, that any person 20 other than a commissioneror an officer of the commissiondemanding such 21 inspection shall produce under the seal of the commission his authority to 22 make such inspection.: provided further, that aA written record of the testi- 23 mony or statement so given under oath shall be made and filed with the commis- 24 sion.

NO. 347 1 AMENDMENT TO SECTION 1 2 On page 1 of the printed bill, in line 15, following "utility" insert: "; 3 provided however, the commission may inspect only those records which are nec- 4 essary to determine whether such expense was properly incurred and should be 5 included, in whole or in part, in the public utility's rates". 6 CORRECTION TO TITLE 7 On page 1, in line 3, following "EXAMINE" insert: "CERTAIN".
