|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1038 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO PUBLIC CHARTER SCHOOLS; AMENDING SECTION 33-5211, IDAHO CODE, TO 3 REVISE THE INFORMATION WHICH THE STATE DEPARTMENT OF EDUCATION MUST DIS- 4 TRIBUTE UPON REQUEST AND TO MAKE TECHNICAL CHANGES; AND AMENDING SECTION 5 33-5212, IDAHO CODE, TO PROVIDE THAT THE STATE BOARD OF EDUCATION MAY 6 REVIEW THE EDUCATIONAL EFFECTIVENESS OF CHARTER SCHOOLS AND REPORT TO THE 7 LEGISLATURE. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 33-5211, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 33-5211. ASSISTANCE WITH PETITIONS -- INFORMATION. (1) The state depart- 12 ment of education shall provide technical assistance to persons or groups pre- 13 paring or revising charter petitions. 14 (2) Upon request, the state department of education shall distribute the 15 following information concerningthea charter school whose petition has been 16 approved: 17 (a) The charter school's petition;. 18 (b) The annual audit performed ateachthe charter school pursuant to the 19 charter school petition;. 20 (c)By not later than July 1, 2004, theAny written report by the state 21 board of education to the legislature reviewing the educational effective- 22 ness of charter schools. 23 SECTION 2. That Section 33-5212, Idaho Code, be, and the same is hereby 24 amended to read as follows: 25 33-5212. REVIEW. The state board of educationshallmay review the educa- 26 tional effectiveness of charter schools under the provisions of this chapter 27 andshallreport to the legislature.not later than July 1, 2004, with recom-28mendations which may include modification, expansion or termination of the29provisions of this chapter.

STATEMENT OF PURPOSE R.S. 10631 The purpose of this legislation is to amend Section 33-5211, Idaho Code, to revise the information which the State Department of Education must distribute upon request and to amend Section 33-52 12, Idaho Code, to provide that the State Board of Education may review the educational effectiveness of charter schools and report to the Legislature. The reason for this legislation is that lending institutions are reluctant to loan money for facilities when the current law provides a perception that charter schools may not operate beyond 2004. FISCAL IMPACT There is no significant fiscal impact as a result of this legislation. Some slight fiscal savings might be realized due to the permissive language with respect to reports.
