|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1064 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO CARBON SEQUESTRATION; AMENDING TITLE 22, IDAHO CODE, BY THE ADDI- 3 TION OF A NEW CHAPTER 50, TITLE 22, IDAHO CODE, TO PROVIDE LEGISLATIVE 4 INTENT, TO PROVIDE FOR THE CREATION OF THE CARBON SEQUESTRATION ADVISORY 5 COMMITTEE, TO PROVIDE FOR MEMBERSHIP AND COMPENSATION OF THE COMMITTEE AND 6 TO PROVIDE THAT THE DEPARTMENT OF AGRICULTURE SHALL PROVIDE ADMINISTRATIVE 7 ASSISTANCE, TO PROVIDE FOR POWERS AND DUTIES OF THE CARBON SEQUESTRATION 8 ADVISORY COMMITTEE, TO PROVIDE THAT THE DIRECTOR OF THE DEPARTMENT OF 9 AGRICULTURE SHALL PREPARE REPORTS, TO PROVIDE FOR POWERS AND DUTIES OF THE 10 DIRECTOR AND TO CREATE THE CARBON SEQUESTRATION ASSESSMENT FUND. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Title 22, Idaho Code, be, and the same is hereby amended 13 by the addition thereto of a NEW CHAPTER, to be known and designated as Chap- 14 ter 50, Title 22, Idaho Code, and to read as follows: 15 CHAPTER 50 16 CARBON SEQUESTRATION ADVISORY COMMITTEE 17 22-5001. LEGISLATIVE INTENT. Increasing levels of carbon dioxide and 18 other greenhouse gases in the atmosphere have led to growing interest in 19 national and international forums for implementing measures to slow and 20 reverse the buildup of such atmospheric constituents. Such measures may poten- 21 tially include the establishment of systems of trading in credits for adoption 22 of practices, technologies or other measures which decrease net emissions of 23 carbon dioxide and other greenhouse gases. Improved agricultural production 24 methods, soil conservation practices and other methods of stewardship of soil 25 resources have great potential to increase carbon sequestration on agricul- 26 tural lands and help offset carbon dioxide emissions from other sectors of the 27 economy. It is in the interest of agricultural producers and the public in 28 general that the director of the department of agriculture document and quan- 29 tify carbon sequestration and greenhouse emissions reductions associated with 30 agricultural practices, management systems and land uses occurring on cropland 31 and rangeland in Idaho. It is the intent of the legislature that efforts to 32 quantify and verify carbon sequestration on agricultural land will enhance the 33 ability of the state's agricultural landowners to participate in any system of 34 carbon or greenhouse emissions marketing or trading. 35 22-5002. CARBON SEQUESTRATION ADVISORY COMMITTEE CREATED -- MEMBERSHIP -- 36 COMPENSATION -- ADMINISTRATIVE ASSISTANCE. (1) The carbon sequestration advi- 37 sory committee is hereby created. The committee shall consist of the following 38 fourteen (14) members, to be appointed by the governor: 39 (a) The director of the department of agriculture or his designee; 40 (b) The director of the department of environmental quality or his desig- 41 nee; 2 1 (c) The director of the department of lands; 2 (d) One (1) member representing the university of Idaho college of agri- 3 culture; 4 (e) One (1) member representing an entity which generates electrical 5 energy; 6 (f) Two (2) members who are producers of field crops, at least one (1) of 7 whom actively employs a minimum tillage management system in his farming 8 operation; 9 (g) Two (2) members who are producers of livestock, at least one (1) of 10 whom is actively involved in range management; 11 (h) One (1) member with expertise in greenhouse emissions marketing or 12 trading; 13 (i) One (1) member representing soil conservation districts, as defined 14 in section 22-2717, Idaho Code; 15 (j) One (1) member representing the ethanol industry; 16 (k) One (1) member representing the transportation industry; and 17 (l) One (1) member representing an environmental protection or conserva- 18 tion organization. 19 (2) Members of the committee shall be compensated as provided in section 20 59-509(b), Idaho Code. 21 (3) The department of agriculture shall assist the committee with admin- 22 istrative support as reasonably requested by the committee. 23 22-5003. POWERS AND DUTIES OF THE CARBON SEQUESTRATION ADVISORY COMMIT- 24 TEE. The carbon sequestration advisory committee shall: 25 (1) Advise and assist the director of the department of agriculture in 26 preparing the reports required by this chapter and in conducting the assess- 27 ment pursuant to section 22-5005, Idaho Code; 28 (2) Recommend policies or programs to enhance the ability of Idaho agri- 29 cultural landowners to participate in systems of carbon trading. Such recom- 30 mendations shall include potential policies or programs designed to optimize 31 economic benefits to agricultural producers participating in carbon trading 32 transactions. Such policies or programs may include, but are not limited to, 33 identifying existing or the potential of creating nonprofit organizations or 34 other public or private entities capable of serving as assemblers of carbon 35 credits or as intermediaries on behalf of producers in carbon trading systems; 36 (3) Encourage the production of educational and advisory materials 37 regarding carbon sequestration on agricultural lands and participation in sys- 38 tems of carbon or greenhouse emissions trading; and 39 (4) Identify and recommend areas of research needed to better understand 40 and quantify the processes of carbon sequestration on agricultural lands. 41 22-5004. REPORTS -- CONTENTS. On or before February 1, 2002, the director 42 of the department of agriculture, in consultation with the carbon sequestra- 43 tion advisory committee, shall prepare a report to the legislature. The report 44 shall include, but not be limited to: 45 (1) The potential for, and potential forms of, greenhouse emissions regu- 46 lation; 47 (2) The potential for development of a system or systems of carbon emis- 48 sions trading or markets for carbon sequestered on agricultural land; 49 (3) Agricultural practices, management systems or land uses which 50 increase stored soil carbon and minimize carbon dioxide or other greenhouse 51 emissions associated with agricultural production; 52 (4) Methods for measuring and modeling net carbon sequestration and 53 greenhouse emissions reductions associated with various agricultural prac- 3 1 tices, management systems or land uses occurring on agricultural land and leg- 2 islation, if any, to define and protect property rights in and attendant to 3 carbon sequestration and greenhouse emissions; 4 (5) Areas of scientific uncertainty with respect to quantifying and 5 understanding greenhouse emissions reductions or soil carbon sequestration 6 associated with agricultural activities; and 7 (6) Any recommendations of the carbon sequestration advisory committee 8 developed pursuant to section 22-5003, Idaho Code. 9 22-5005. POWERS AND DUTIES OF THE DIRECTOR. (1) In consultation with the 10 carbon sequestration advisory committee, the director of the department of 11 agriculture shall assess agricultural lands in Idaho for past carbon seques- 12 tration and future carbon sequestration potential. The assessment shall seek 13 to quantify carbon sequestration associated with various agricultural prac- 14 tices, management systems and land uses occurring on agricultural lands in 15 this state. On or before March 1, 2002, the director shall publish a report of 16 the findings. From time to time, the director may update the findings as 17 advancements in understanding of the processes of carbon sequestration and new 18 data become available. 19 (2) The assessment shall be conducted in a manner that shall provide a 20 means for owners of agricultural land to estimate past and future net carbon 21 sequestration resulting from agricultural practices, conservation measures, 22 management systems and land uses occurring on their property. The director of 23 the department of agriculture may contract and cooperate with the natural 24 resources conservation service of the United States department of agriculture 25 to conduct assessment activities provided for in this section. 26 (3) The director may apply for and accept grants, gifts or other sources 27 of public and private funds to carry out the purposes of this chapter. 28 22-5006. CARBON SEQUESTRATION ASSESSMENT FUND CREATED. There is hereby 29 created and established in the state treasury a fund to be known as the 30 "Carbon Sequestration Assessment Fund," which shall consist of such funds as 31 may be appropriated for that purpose by the legislature, grants, donations or 32 moneys from other sources. The fund shall be administered by the department of 33 agriculture in order to carry out the purposes of this chapter. Moneys in the 34 fund may be expended pursuant to appropriation. Any interest earned on the 35 investment of idle moneys in the fund shall be returned to the fund.

There is hereby 37 created and established in the state treasury a fund to be known as the 38 "Carbon Sequestration Assessment Fund," which shall consist of such funds as 39 may be appropriated for that purpose by the legislature, grants, donations or 40 moneys from other sources. The fund shall be administered by the soil conser- 41 vation commission in order to carry out the purposes of this chapter. Moneys 42 in the fund may be expended pursuant to appropriation. Any interest earned on 43 the investment of idle moneys in the fund shall be returned to the fund.
STATEMENT OF PURPOSE RS lO930Cl The purpose of this legislation is to create a carbon sequestration advisory committee. This committee will identify and recommend policies and programs dealing with carbon trading for non-industrial forest and agricultural lands that will enhance the ability of the landowners to offset carbon emissions from other sectors of the economy. This program could be very beneficial for agricultural and non-industrial forest landowners. The Chairman of the Soil Conservation Commission, in consultation with the carbon sequestration advisory committee, will provide a number of reports to the legislature. FISCAL IMPACT The fiscal impact will be the compensation of the members of the committee as provided in Idaho Code 59-509 (b).
