|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1124 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO DISCLOSURE OF NONPUBLIC PERSONAL INFORMATION; AMENDING CHAPTER 13, 3 TITLE 41, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 41-1334, IDAHO 4 CODE, TO PROHIBIT THE DISCLOSURE OF NONPUBLIC PERSONAL INFORMATION TO 5 NONAFFILIATED THIRD PARTIES AND TO PROVIDE FOR THE ADOPTION OF RULES BY 6 THE DIRECTOR OF THE DEPARTMENT OF INSURANCE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Chapter 13, Title 41, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 10 ignated as Section 41-1334, Idaho Code, and to read as follows: 11 41-1334. DISCLOSURE OF NONPUBLIC PERSONAL INFORMATION. (1) No person 12 shall disclose any nonpublic personal information to a nonaffiliated third 13 party contrary to the provisions of title V of the Gramm-Leach-Bliley act of 14 1999, public law 106-102. 15 (2) The director may adopt rules necessary to carry out this section. 16 Such rules shall be consistent with, and not more restrictive than, the stan- 17 dards contained in regulations promulgated under title V of the Gramm-Leach- 18 Bliley act of 1999, public law 106-102, by the federal regulatory agencies 19 governing financial institutions doing business in Idaho.
STATEMENT OF PURPOSE RS 10780 In 1999, the United States Congress passed the Gramm-Leach-Bliley Act (public law 106-102) . This Act restricts the flow of certain information, termed "non-public personal information," that may be released by "financial institutions," a term defined within the Act. This proposed legislation would permit the Idaho Department of Insurance to promulgate rules designed to carry out the requirements set forth in the Gramm-Leach-Bliley Act. Without state issued rules, federal rules from regulatory agencies governing financial institutions will be imposed upon the state. FISCAL IMPACT The fiscal impact of the Bill is estimated to be $1,500 for printing costs connected with rulemaking.
