  1                                        AN ACT
  2    RELATING TO SCHOOL LIBRARIANS; AMENDING CHAPTER 12, TITLE 33, IDAHO  CODE,  BY
  3        THE  ADDITION  OF  A  NEW  SECTION 33-1213, IDAHO CODE, TO REQUIRE CERTAIN
  4        SCHOOLS TO EMPLOY CERTIFIED SCHOOL  LIBRARIANS,  TO  PROVIDE  FOR  CERTAIN
  5        APPROPRIATIONS, TO PROVIDE FOR APPLICATION FOR FUNDING, TO PROVIDE CERTAIN
  6        REQUIREMENTS  AND  TO  PROVIDE AN EXCEPTION FOR COMPLIANCE WITH THE PROVI-
  7        SIONS OF THE SECTION.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Chapter 12, Title 33, Idaho Code, be,  and  the  same  is
 10    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 11    ignated as Section 33-1213, Idaho Code, and to read as follows:
                                                                        
 12        33-1213.  SCHOOL LIBRARIAN PROGRAM. (1) No later than July  1,  2006,  and
 13    each  year thereafter, every school district shall employ a minimum of one (1)
 14    full-time person certified as, and serving in the capacity of, school  librar-
 15    ian  under the provisions of section 33-1201, Idaho Code, in every school with
 16    total enrollment in excess of two hundred fifty (250) students.
 17        (2)  The legislature shall appropriate at least the following amounts  for
 18    each of the following fiscal years to fund the requirements of this section:
 19        2002                                                            $  750,000
 20        2003                                                            $1,500,000
 21        2004                                                            $3,000,000
 22        2005                                                            $5,300,000
 23        2006 and each year thereafter                                   $7,500,000
 24        (3)  Application for such funding shall be made by school districts to the
 25    state  department  of  education. The state department of education shall dis-
 26    tribute funds to qualifying school districts based on the order in  which  the
 27    qualifying  district applications are received by the state department of edu-
 28    cation until such time as the annual appropriated  funds  are  distributed  in
 29    full.  The  department  is  not required to distribute funding to any district
 30    after annual appropriated funds are fully  distributed.  Any  school  district
 31    that  does  not  receive  a distribution from the department in any given year
 32    shall not be required to comply with the provisions of this section. In  order
 33    to  qualify for funding, districts that apply for funding must demonstrate, in
 34    writing, to the state department of education that:
 35        (a)  They have employed or will employ a certified  media  generalist  for
 36        the next ensuing school year; and
 37        (b)  They  are  committed  to developing a program of information literacy
 38        that includes components of reading advocacy for improved reading achieve-
 39        ment and, in collaboration with classroom teachers, integrates information
 40        technologies into the learning environment.
 41        (4)  If the legislature fails to appropriate funds as provided in  subsec-
 42    tion  (2) of this section in any given year, the program will thereafter cease
 43    to be funded and school districts shall no longer be required to  comply  with

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE
                             RS 11091

This is intended to ensure that by July 1, 2006, all schools
where the enrollment exceeds two hundred fifty (250) students
employ at least one full-time certified librarian to staff the
school s library and/or media center and to provide a program of
information literacy, which includes components of reading
advocacy for improved reading achievement and, in collaboration
with classroom teachers, integrating information technologies
into the learning environment.
                           FISCAL IMPACT
 Based on the phase-in schedule contained in this legislation, the
cost of employment of two hundred seventy (270) new full-time
certified librarians at an estimated cost of $28,000 per
librarian would be as follows:
